(Stillwater, Okla.) — A 42-year-old man convicted of attempted forcible rape in Louisiana has been ordered held in the Payne County Jail on $25,000 bail pending a Jan. 18, 2022, preliminary hearing on a charge of failure to register as a sex offender in Stillwater.
Alan Paul Yates Jr. was initially arrested at 4:20 pm on Nov. 12 by Stillwater Police Officer Miguel R. Najera for trespassing at an apartment located in the 600 block of E. Redbud, an affidavit said.
A woman reported to police that “she had several people in an apartment that were trespassing…she advised they had told her someone’s brother allowed them to stay there, but she advised they were not to be in the apartment, and she wished to press charges,” the affidavit alleged.
“I announced Stillwater police into the doorway, and three subjects came downstairs,” including Yates, who gave another name, the officer alleged in his affidavit.
Two of the individuals provided accurate information, but Yates did not, the affidavit alleged.
Yates did provide a social security number through which a dispatcher learned his name was Alan Yates with a driver’s license number from Louisiana, the affidavit alleged.
Two days later, Stillwater Police Sgt. Terry Low told the officer, “Alan Yates had continued to give false information to the detention staff and had provided false information on his booking sheet,” the affidavit alleged.
“Yates also continued to refuse to provide any information to the jail staff and refused to allow them to fingerprint him.
“Dispatch was able to obtain a booking photo from Escambia County in Florida and we were able to positively identify the subject in custody as Alan Yates.
“We were also able to determine that Florida had charged Yates with failing to register as a sex offender.
“We have no record that he has registered as a sex offender within our city limits,” the Stillwater officer alleged in his affidavit.
Yates had been convicted on May 18, 2005, in St. Charles Parish of Louisiana of attempted forcible rape, court records alleged.
