(Stillwater, Okla.) — A Cushing man admitted Friday that he had failed to comply with his requirements for registering as a sex offender — by failing to notify the Payne County Sheriff’s Office of his whereabouts or residency.
Samuel Joseph Inzerillo, 30 — who said in court Friday that his name has been legally changed to Sammy Brake Jr. — was arrested July 15 in Chickasha on a Payne County warrant, court records show.
Inzerillo had been released from prison in 2009 after serving about six years for lewd proposal to a child in Canadian County in 2000, court records show.
As part of a plea bargain approved Friday by Payne County Associate District Judge Stephen Kistler, Inzerillo was given a three year sentence — all suspended except 90 days in jail — and ordered to pay the cost of his incarceration.
Inzerillo was also ordered to register as a sex offender and pay $1,000 in fines and assessments by Kistler.
When he serves his Payne County Jail sentence, Inzerillo is due to be transported to authorities in Canadian County, since they have placed a hold on him, court records show.
Payne County Sheriff’s Deputy Bobby Miller had written in an affidavit filed in July that on several occasions he went to verify a sex offender’s residency in rural Cushing at 4610 W. 9th Street — which Inzerillo had put on his registration paper work for Payne County.
“Every time I went to the address, I was informed by his mother that he wasn’t there. The last time I went to the address was on June 3 at approximately 1:46 p.m.
“I made contact with Mr. Inzerillo’s mother and I asked her if he was there. She advised he came and got the rest of his clothes and was living in Shawnee.
“I asked her when the last time she had seen him was and she advised about a week prior. I advised her that I have been trying to contact him, and she advised she told him he needed to get registered,” the deputy wrote in his affidavit.
According to Canadian County court records, in 2000 Inzerillo was originally given a two-year prison term followed by eight years of probation for lewd proposal to a child.
Two years of his probationary sentence were revoked in 2003 in that case, court records show.
Four years later, two more years of his probationary sentence were revoked and he apparently was released from prison in 2009, court records show.
Inzerillo was also convicted in 2000 of bogus checks in Canadian County for which he was given a concurrent one-year prison term, court records show.
Inzerillo was also convicted in 2006 of failure to comply with the sex offender registration act in Oklahoma County in 2005, for which he was given a two-year prison term, court records show.
