(Stillwater, Okla.) — A 33-year-old Cushing woman accused of breaking the driver’s side window of a semi-truck at Ahrberg Milling, being intoxicated in public, and attacking Cushing Police Officer Sara Reynolds during the booking process at the city jail has been ordered to appear in court this afternoon on a three-count charge.
If convicted of the felony of assault and battery on a police officer by punching Reynolds in the face, kicking her, and pulling her hair, Kristy Morgan Speaks could be given as much as a five-year prison term and a $500 fine. Speaks was ordered held in the Payne County Jail on $6,000 bail.
If convicted of molesting a 2000 Freightliner truck, Speaks could be given as much as a six-month jail term and a $500 fine. If convicted of being intoxicated in public, Speaks could be given as much as a 30-day jail term and a $100 fine.
Cushing Police Officer David Smith had arrested Speaks at 9:05 pm on March 11 at Ahrberg Milling, four minutes after he was sent there regarding “a female throwing rocks at trucks and trying to fight employees,” his affidavit alleged.
“I was attempting to gain further information when she advised me she let Dale drive because she was drunk. Kristy advised me she had taken a couple hits of meth earlier in the day,” the officer alleged in his affidavit filed last week.
“I asked Kristy if she had broken out the window in the semi; she replied yes,” the officer alleged in his affidavit. A man said “he had heard honking so he ran out of the mill to see what was happening,” and saw the woman’s arm inside the semi, the affidavit alleged. The woman “yelled at him stating she needed to get out of there,” the affidavit alleged.
“Through further investigation, it was discovered the diesel tank cap may have been used to break out the driver’s side window, due to the cap being found in the passenger-side floorboard,” according to the affidavit, which noted the owner said nothing was taken from the semi.
About 11 minutes after the woman’s arrest, Cushing police were dispatched to the city jail regarding a “fight in-progress,” according to another affidavit by Smith.
“Upon entering the jail, I observed Officer Sara Reynolds utilizing an arm-bar-like technique in order to subdue Kristy from further assaulting her. I also observed dispatcher Roy Ivy, who was straddling Kristy in order to assist Officer Reynolds to keep the arrestee from further assaulting,” Smith alleged in his affidavit.
“Sgt. Piatt and I then were able to use minimal force necessary to handcuff Kristy behind her back. While waiting for medics to come and evaluate Kristy, Kristy was still handcuffed and sitting on the floor. Kristy kicked me in my shins and continued to kick at me until I used minimal force necessary to place Kristy on her side and wrap my legs around hers in order to stop her from kicking.
“I advised Kristy to stop and she complied briefly. While Kristy was cooperating, I was able to sit her upright in a sitting position again. Kristy then kicked at me again striking me in my shins; however, this time I was able to back step away from Kristy in order to stop the altercation,” the officer alleged in his affidavit.
“Officer Reynolds’ injuries included a distinct red mark just above her left eyebrow, abrasions on her chin and under her right eyebrow, abrasions on her right lower neck and her right hand on her first finger knuckle, and a red mark on her neck behind her left ear,” according to the affidavit.
“Also during the altercation with Kristy, Officer Reynolds’ name plate that was located just above her left breast pocket was ripped off and bent,” the affidavit said.
After reviewing camera footage and interviewing the injured officer and dispatcher, “It was determined Officer Reynolds was attempting to complete the book-in process on Kristy when Kristy began to disobey Officer Reynolds’ commands,” the affidavit alleged.
“Kristy then attempted to push the Oklahoma state’s intoxilyzer 8000 off of the table when Officer Reynolds was able to catch it before falling off the table.
“Kristy then started to fight Officer Reynolds,” by punching her in the face, pulling her hair and kicking her, the affidavit alleged.
“Officer Reynolds was able to take Kristy to the ground to gain control of her. Officer Reynolds subsequently placed Kristy in an arm-bar-like hold and returned blows to Kristy — in order to stop Kristy from punching, biting and attempting to stab Officer Reynolds with keys and Officer Reynolds’ name plate that was ripped off during the altercation,” the affidavit alleged.
“During this time, dispatcher Ivy called for officers’ assistance over the department radio before assisting Officer Reynolds in subduing Kristy to stop the altercation. A short time later, Sgt. Piatt and myself arrived and took over the situation,” Smith alleged in his affidavit.
