(Stillwater, Okla.) — Two Stillwater men and a female teenager from Perry have been jailed in connection with the repeated shooting of an acquaintance in a Stillwater apartment complex parking lot.
The victim, 20-year-old Darian Jamal Cyphers of Perkins, was seriously injured but survived, according to Stillwater Police Captain Kyle Gibbs.
Dreshawn Edward Smith, 20, and Blake Mitchel Martin, 24, both of whom are alleged to have fired shots at Cyphers as he sat in a car, remain in the Payne County Jail on $100,000 bail each on charges of a drive-by shooting, assault and battery with a deadly weapon and possessing a firearm after a former felony conviction, court records show.
Mikayla Dawn Roberts, 19, who allegedly lured Cyphers to the location where he was shot multiple times, remains in the Payne County Jail on $50,000 bail on charges of participating with her co-defendants in a drive-by shooting and assault and battery with a deadly weapon, court records show.
All three defendants have been ordered to appear in court on Dec. 7 when they can seek a preliminary hearing on their charges.
“Cyphers said that on the day of the shooting, Nov. 4, he needed a pain pill because he was going to get a neck tattoo, so he contacted Mikayla by phone and asked if she knew where he could get a pain pill,” Stillwater Police Detective John Paul Johnson alleged in an affidavit.
“Mikayla did some searching and eventually called Cyphers back,” some time after 5 p.m. that day, the affidavit alleged.
“Cyphers said Mikayla told him she could get him one Roxicodone narcotic pain reliever for $30 or two for $50. Cyphers said he only needed one and Mikayla told him to meet her,” at the Cedar Oaks apartment complex at 4100 W. 19th Ave. in Stillwater, the affidavit alleged.
“Cyphers said when he arrived, he saw Mikayla standing on the sidewalk apparently waiting on him. Cyphers said she got in the car and he gave her the money for the pill.
“Cyphers said he had pulled in and parked next to the Tahoe, which was backed into a parking space.
“Cyphers said Mikayla left the gun she had pulled out, in the car when she got out, walked around his car and the back of the Tahoe and got in the passenger side of the Tahoe.
“Cyphers said he pulled out his phone and started looking at it, but then looked up and saw muzzle flashes.
“Cyphers was able to see well enough to see that Dreshawn Smith was sitting in the back seat of the Tahoe, immediately behind the driver’s seat on the driver’s side, and Dreshawn was shooting at Cyphers through the driver’s window of Cyphers’ car.
“Cyphers also saw that the driver of the Tahoe was Blake Martin and that Blake was shooting at him as well.
“Cyphers was able to crawl over the seat to the back passenger side and exit his car there.
“Once outside, he heard Dreshawn tell Blake to drive off,” the affidavit alleged.
“Cyphers is very familiar with Dreshawn from going to school together and having mutual friends such as Mikayla. Cyphers has met Blake and knows him.
“Cyphers said Dreshawn would want to try to kill him because of a personal vendetta.
“Cyphers said he had sex with Dreshawn’s girlfriend last year while Dreshawn was incarcerated and there is a disagreement over personal property from the past.
“When Dreshawn called Cyphers about these issues after getting out of incarceration, Cyphers offered to meet Dreshawn somewhere to settle things.
“Cyphers said Dreshawn declined – saying instead that he (Dreshawn) would ‘go to war,’” the affidavit alleged.
Based on physical evidence and statements from witnesses, “it appears that Dreshawn Smith, Blake Martin and Mikayla Roberts were acting in concert with Mikayla luring Cyphers into a position where, at a minimum, Dreshawn could shoot Cyphers from a concealed posit
ion within the suspect’s Tahoe, and Blake could drive the trio from the scene,” the affidavit alleged.
While Cyphers was sitting in a Malibu about 7:40 p.m. Nov. 4, “someone fired three shots from the rear driver’s side seat of the Tahoe through the driver’s side window of the Malibu, into the driver’s compartment, and subsequently into Cyphers from a very close range,” the affidavit alleged.
“Three 9mm spent shell casings were found around the driver’s side rear corner of the victim’s vehicle,” the affidavit said.
“Several apartment complex residents reported hearing shots fired and a subject yelling for help,” the affidavit said.
A witness picked Cyphers up and volunteered to take him to the hospital, the affidavit said.
Thirty-one witnesses, including 19 civilians, have been listed by the prosecution in connection with the shooting.
According to court records, Smith was convicted last year of possession of methamphetamine in Stillwater, ordered into the state’s prison boot camp program, and six months later placed on 10 years’ probation except for serving six months in jail.
Smith has also been charged with possessing a firearm on Nov. 14 in Stillwater after a former felony conviction, a case on which he is also scheduled to appear in court on Dec. 7.
Martin has five prior felony drug convictions, court records show:
* possession of oxycodone in Payne County in 2009 for which he was jailed for six months, ordered into Drug Court and given a four and one-half year suspended sentence in 2010, but violated his probation in 2012 and 2014 for which he was given jail terms;
* possession of methamphetamine in Payne County in 2010 for which he was given a concurrent six-month jail term, ordered into Drug Court and given a four and one-half year suspended sentence in 2010, but violated his probation in 2012 and 2014 for which he was given jail terms;
* possession of lortab without a prescription in Payne County in 2011 for which he was given a 10-year suspended sentence in 2012 that was revoked in 2014 to 330 days in jail;
* possession of methamphetamine with intent to distribute in Oklahoma County in 2012 for which he was given a five-year suspended sentence in 2013 concurrent to his Payne County suspended sentences;
* possession of methamphetamine with intent to distribute in Payne County in 2013 for which he was given a 20-year suspended sentence in 2014 except 330 days in jail.
