(Stillwater) — A Stillwater teenager who is currently on probation for beating his girlfriend in Cushing and breaking into a house in Stillwater has been charged with forcing a 14-year-old boy to perform a sex act on him.
An arrest warrant on a forcible oral sodomy charge was issued a week ago for Dustin Jo Crosby, 18, who was not yet in custody Thursday, according to the Payne County Sheriff’s Office.
Crosby, who is 5’11” and weighs 240 pounds, could be given as much as a 20-year prison term if convicted of his latest charge, court records show.
Stillwater Police Detective Sgt. Jeff Watts began an investigation on Sept. 22 after a 14-year-old boy reported to his counselor that he was sexually assaulted on Sept. 21 by Crosby, an affidavit said.
The boy said that he was visiting a relative who stays in a shed behind Crosby’s house in Stillwater when the boy needed to use the bathroom, Watts wrote in an affidavit.
The boy said that while he was using an upstairs bathroom, Crosby came in and watched him — then threatened to stab him if he didn’t perform an oral sex act, the affidavit alleged.
The boy said that Crosby forced him into Crosby’s bedroom near the bathroom, poured vodka down the boy’s mouth and forced his penis into the boy’s mouth, the affidavit alleged.
The boy said that he bit Crosby’s penis and then fled from the house, the affidavit alleged.
When the police sergeant interviewed Crosby that day, Crosby initially denied providing any alcohol to the boy and denied any sexual contact with him, the affidavit said.
Later in the interview, Crosby said that the boy came to his residence after visiting a relative living in the shed behind his house,  and “was acting drunk and asked Dustin (Crosby) if he could drink some of his vodka,” the affiadvit alleged
Crosby said that he told the boy he had to do something if he wanted some of the vodka — either fight him or perform a sex act on him, the affidavit alleged.
Crosby said that the boy “opted for oral sex,” and so Crosby provided the boy with a drink of vodka that he had in a soft drink bottle, the affidavit alleged.
Crosby said that after the boy suddenly stopped performing the sex act, Crosby told him he would not provide him with any more vodka and the boy left the residence, the affidavit alleged.
When the police sergeant again interviewed the boy a week later and told him about Crosby’s statements, the boy “maintained the story he gave was true and stated Dustin (Crosby) was lying,” the affidavit alleged.
Three days after the boy was allegedly sexually abused by Crosby and the matter was still under investigation by the Stillwater Police Department, the boy’s mother sought an emergency protective order aganst Crosby, which was denied by Associate District Judge Stephen Kistler on Sept. 24, court records show.
Three weeks ago, Crosby pleaded guilty to beating his girlfriend in Cushing on Aug. 18 and breaking into a rental house in Stillwater on Sept. 23, court records show.
Crosby was placed on two years’ probation in both cases by Special District Judge Phillip Corley, who ordered him to perform the Menders’ program and 30 hours of community service in his domestic abuse case.
Corley ordered him to perform 20 hours of community service in his breaking and entering case, along with paying a $100 fine in each case.
In the domestic abuse case, Cushing Police Officer Brad Staggs wrote in an affidavit that Crosby’s girlfriend said that they got into an argument after she confronted Crosby about using her car in a careless manner, the affidavit said.
She said that Crosby retaliated by punching her in the head repeatedly, headbutting her in the forehead, and poking her eyes in the presence of her children, all between 10:30 p.m. and 11:30 p.m. on Aug. 17, the affidavit said.
She said that the next day, Crosby abused her between 2:30 p.m. to 3:45 p.m. after he found that she had been texting another man, the affidavit said.
She said that Crosby pushed her to the ground, pulled her up by grabbing her hair, put his hands around her throat and pushed her back against the wall, then lifted her off the ground by her throat and eventually let her go — so she fell to the ground, the affidavit said.
She said that Crosby left the room briefly, then came back, punched her hard in the chest and hit her on both sides of her face — before she kicked him off of her and called her mother to call police, the affidavit said. She said she was able to get up and leave the residence, the affidavit said.
She had red marks and swelling on her right cheek, tenderness on the top of her head, soreness in her jaw line and left ear, a red mark on her chest and red discoloration on the right side of her neck, as well as bruises on the inside of her left arm, the affidavit said. She was treated in the Cushing Regional Hospital emergency room.
The next day, she sought and obtained an emergency protective order against Crosby, but the protective order was dismissed by Special District Judge Luke Duel, when she failed to appear in court on Oct. 7, court records show.
The mother of two of Crosby’s male friends sought an emergency protective order against Crosby on June 22 that was denied by Special District Judge Michael Stano, court records show. In that case, the woman wrote, “Dustin (Crosby) never issued the threats; however, he made it known that he’d back up his brother,” in threats against her sons and her home, she alleged in her application for a protective order.
Another woman, who was then Crosby’s girlfriend, sought and obtained an emergency protective order on March 4 against Crosby that was made final on March 12 by Judge Kistler, court records show.
In that case, the woman said that Crosby threw a hamburger at her, then pushed her down and slapped her when she tried to get up, her application said.
When she started screaming for his brother, “Dustin (Crosby) started to choke me and put his hand over my mouth,” before ordering her to pick up the food he had thrown at her, the application said.
“Since I wasn’t doing it as fast as he wanted, he threw a fork at me and it stuck in my right arm. Then he left the room and I followed him to try and leave. He turned around, pushed me into the hallway wall and started to choke me again to where I almost blacked out.
“He told me to go downstairs. I was sitting on the couch. He kept yelling and hovering over me and slapping me. I put my feet on his chest and tried to push him away.
“Then he grabbed a broomstick and hit me across the left arm. Then we went upstairs and went to sleep. Later, my mom came and picked me up and took me to the police station.
“I want the protective order because I am scared of what he might do and he has beaten me and hit me before,” she wrote in her protective order application.
