(Stillwater, Okla.) — A Stillwater man has been jailed on charges of raping a 10-year-old girl to whom he is related and having her perform oral sex on him while she was visiting in his home in April.
If convicted of first-degree rape and forcible oral sodomy, Cody Montana Zimmer, 27, could be given a sentence of life in prison without parole, plus 20 years. Zimmer was arrested last week and jailed on $50,000 bail with the condition that if he posts bond, he have no contact with the girl. He was scheduled to appear in court this week.
The alleged abuse came to light when the girl complained to a female relative that it hurt when she went to the bathroom, Stillwater Police Sgt. Jeff Watts wrote in an affidavit.
The girl asked her female relative “if a 10-year-old could get pregnant,” according to the affidavit.
During a conversation with her female relative, the girl said that Zimmer had raped her and put his penis in her mouth, the affidavit alleged.
The disclosure to the female relative came around midnight and the woman brought the girl to the OU Children’s Medical Center the following morning, according to the affidavit.
The girl was asked by a social worker at the Children’s Medical Center about whether Zimmer said anything to her about not telling, the affidavit said.
The girl said “he told her not to act it out, play it out or telling anything or else,” the affidavit alleged.
“Cody told her if she did, something would happen to her family and she would disappear to one of those places the foster kids go to and she didn’t want that,” the affidavit alleged.
The girl said that when Zimmer was “doing this to her, he would tell her that her mom was proud of her,” the affidavit alleged. The girl’s mother had been killed in a car accident when the girl was 2-years-old, the affidavit said.
The girl told the hospital social worker that Zimmer “had been raping her for a long time and he told her not to tell anybody,” the affidavit alleged.
The girl said “she didn’t tell because she did not want him to get arrested,” the affidavit alleged.
Asked by the social worker what made her decide to tell this time, the girl said her female relative “kept talking to her and it was hurting her not to tell the truth,” the affidavit alleged.
The girl said that the first time it happened, she was five-years-old, the affidavit alleged.
The girl said the last time something happened was “yesterday,” the affidavit alleged. The girl said while she was alone with Zimmer, she was raped and went into the bathroom to cry, the affidavit alleged.
The girl said that Zimmer told her not to cry or he would go to jail, the affidavit alleged.
The girl said that Zimmer had raped her “over and over,” except that he used to do it in her rear, the affidavit alleged.
The girl said that the last time Zimmer had done anything to her prior to the previous day was in the middle of the school year “and he told her it would never happen again and she believed him — then he did it again,” the affidavit alleged.
The girl told the social worker that on one occasion Zimmer wanted her to have sex with a dog, the affidavit alleged. She said that the dog ran off, the affidavit said.
The girl said Zimmer “then stated he would do it and did it to her,” the affidavit alleged.
When a rape examination was performed on the girl at the OU Children’s Medical Center, “there were findings of trauma in the form of bruising, an abrasion and a small laceration,” within the girl’s vagina, the affidavit said.
During an interview with the police detective sergeant, Zimmer denied sexually abusing the girl and said that the girl’s relatives were responsible for the allegations against him, the affidavit said.
The girl’s relative said that a few years ago, the girl had told her that Zimmer was “humping her,” the affidavit alleged.
The girl’s relative said she made a referral to the state Department of Human Services and the girl was forensically interviewed at the Saville Center in Stillwater, the affidavit said.
The girl’s relative said the girl did not make any disclosures during the forensic interview, the affidavit said.
The girl told the hospital social worker “she had talked to someone, but she denied anything was happening,” the affidavit said.
The girl said “she keeps things to herself and she denied everything when questioned,” but she said Zimmer had actually raped her, the affidavit alleged.
