  (Stillwater, Okla.) — A 35-year-old Stillwater man accused of hitting his girlfriend in the forearm, elbow, knee, ribcage and head with a metal pipe has been ordered to appear in court on Dec. 2 when he can seek a preliminary hearing on a felony charge of domestic assault and battery with a dangerous weapon.
    If convicted, Brian Le Drake, whose middle name has also been spelled as Lee, could be given as much as a 10-year prison term. He remains free on $10,000 bail with an order to have no contact with the woman, court records show.
    Payne County Sheriff’s Deputy Joseph Jones was dispatched at 4:41 pm on Oct. 18 to Morning View RV Park in rural Stillwater on a report of a domestic assault and battery that was no longer in progress, according to his affidavit.
    A woman, who was crying and had a bleeding cut above her right ear, said that she and her boyfriend got into an argument that turned physical after he woke up while she was playing games on her phone, the affidavit alleged.
    She said, “when Drake woke up, he was looking for his car keys and became upset because he could not find them and began throwing things around the RV and making a mess,” the affidavit alleged.
    She said, “Drake got in her face and was yelling and spitting at her,” the affidavit alleged. She said, she “curled up in a ball to protect her body because she was fearful Drake would hit her,” the affidavit alleged. She said, “Drake went outside, and she got up and started gathering her belongings and that is when Drake hit her with an unknown object,” the affidavit alleged.
    She said, “she began throwing items at Drake to get him away from her. (She) reported Drake picked up the portable charcoal grill and threw it at her. (She) advised Drake picked up a metal pole used for the table and began swinging it at her like it was a baseball bat,” the affidavit alleged.
    She said, “Drake hit her with the metal pole in the left forearm, right elbow, knee, left ribcage and right side of her head. (She) reported “Drake told her he was going to call the police, and when she told him she was already on the phone with them, he said too late and took off walking south on Dobbs Lane. (She) advised prior to Drake leaving, he threw the metal pole in the woods,” the affidavit alleged.
    She said, “Drake has never hit her before but has yelled and spit on her before,” the affidavit alleged.
    The deputy took photographs of an abrasion on her left ribcage, an abrasion, and a bump on her left forearm, along with redness and bruising on her right elbow, which she said were all caused by Drake, the affidavit alleged.
    Payne County Sheriff’s Deputy Cooper Tanner left the scene to locate Drake whom he arrested, the affidavit said.
    “LifeNet EMS came to assist (her) injuries, and she was offered transportation to the hospital, which she declined, stating she had a friend who could take her,” the affidavit said.
