(Stillwater) — A Perkins man has been given a 6-year prison term for having sex with a friend’s 14-year-old daughter at a Perkins residence and at a Yost Lake cabin in July.
Johnny Frank Martin, 32, pleaded guilty last week to two counts of second-degree rape of the girl, who does not live in this area, court records show.
Martin was advised in court by Associate District Judge Stephen Kistler that he must serve at least 85 percent of his 6-year sentence in custody.
On his release from prison, Martin must immediately register as a sex offender and serve nine years of probation, Kistler ordered.
The girl was visiting in Perkins at the time of the incidents last summer, Payne County Sheriff’s Investigator Larry Kitchel wrote in an affidavit.
The girl told a child welfare investigator with the state Department of Human Services that she and Martin had text-messaged and talked about having sex before it happened, the affidavit said.
Under state law, the 14-year-old girl could not legally consent to sexual relations.
The girl said that she was caught when a relative “found her texting Martin, so she told her mother that she was not a virgin anymore, that she had sex with Martin,” the affidavit said.
