(Stillwater, Okla.) — A Perkins man has been charged with sexually abusing a friend’s 8-year-old son, using him for child pornography and downloading obscene material on his cell phone, all in late January.
Gregory Joseph Winnie, 25, was arraigned on a three-count felony charge and released on $5,000 bail last week with the condition that he have no contact with the boy. Winnie was ordered to appear in court on April 6.
If convicted of fondling the boy on Jan. 26, Winnie could receive a minimum of a 25-year prison term, court records show.
If convicted of procuring child pornography on Jan. 26, Winnie could receive a maximum of a 20-year prison term and a $25,000 fine.
If convicted of downloading obscene material to a computer on Jan. 30, Winnie could receive a maximum of a 10-year prison term and a $20,000 fine.
Perkins Police Investigator Charles Danker was contacted at 11:30 a.m. on Jan. 29 by the boy’s mother, who said her son had been sexually assaulted by Winnie, a close friend of her boyfriend, an affidavit alleged.
She said that Winnie was a good friend of the family and staying the night at her residence quite a bit, the affidavit said.
She said that at 5:10 a.m., about 10 minutes after she awoke to get ready for work, she heard a phone alarm going off in the living room and went to turn it off, the affidavit alleged.
She said that the “the alarm was on Greg’s phone and when she swiped her finger across the screen, a photograph of her son’s private area was on the phone,” the affidavit alleged.
She said she woke her boyfriend and his brother, who have been Winnie’s friends for about 15 years, and “informed them of the incident,” the affidavit alleged. She said that when they questioned Winnie, he denied it, the affidavit said.
She said as she was on her way to work, “she received a phone call from Greg and he admitted he took the pictures on Monday,” the affidavit alleged.
She said “Greg also stated he was on painkillers while consuming alcohol,” the affidavit alleged.
She said that Monday night, her son and Winnie were playing video games in her bedroom, the affidavit alleged.
She said she was home except for a short time sometime after dark when she had to run to a local store, while her boyfriend was in the living room feeding their toddler, the affidavit alleged.
She said “when she saw the pictures, she knew they were taken in her bedroom because she recognized her sheets on her bed,” the affidavit alleged.
She said the cell phone also contained pictures of Winnie’s private area, the affidavit alleged.
The Perkins police investigator said that at about 2:40 p.m. he and Chief Bob Ernst started to interview Winnie, according to the affidavit.
Winnie disclosed that on Monday, Jan. 26, he and the boy were sitting in the back bedroom and playing video games when pictures were taken on the cell phone, the affidavit alleged.
“Greg stated he agreed and felt so guilty afterwards,” the affidavit alleged.
“Chief Ernst asked how the photographs turned into nude photographs and Greg stated that was the thing from the get go,” the affidavit alleged.
Winnie claimed that it was the boy’s idea to take pictures, the affidavit said.
“Greg stated he had similar incidents happen to him when he was younger. Greg stated it started as a game – he tried to minimize by saying boys will be boys,” the affidavit alleged.
“Greg gave Chief Ernst permission to look through the phone. Gregory stated that the phone he had and taken the pictures with is a loaner phone, because his other phone is broken,” the affidavit alleged.
“Gregory stated he immediately went today and enrolled to get help to do inpatient treatment,” the affidavit alleged.
“Gregory stated that he has been on a slippery slope the last year and a half to two years…Gregory stated that he had lost some close friends and relatives,” the affidavit alleged.
“Chief Ernst informed Gregory that it is hard to believe an 8-year-old can manipulate a 25-year-old, but it is easier to believe a 25-year-old can manipulate an 8-year-old and Gregory said that is a true statement,” the affidavit alleged.
“Gregory stated he could try to minimize it, but the fact of the matter is I did do it. I took the pictures and just sat there. He touched him,” the affidavit alleged.
“When asked why he was touching him, Gregory stated he didn’t know,” the affidavit alleged.
The following day, the boy was interviewed at the Saville Center in Stillwater, the affidavit said.
The boy disclosed that Winnie touched him in his genital area and he told him not to, the affidavit alleged.
The boy said that Winnie took pictures of him with his pants down with a cell phone while the boy was asleep, the affidavit alleged.
He said he knew this “because Gregory (Winnie) showed him the pictures,” the affidavit alleged.
The boy said “he feels mad about the pictures,” and that he never sleeps with his clothes off, the affidavit alleged.
Investigator Danker received a search warrant that day for Winnie’s cell phone and saw what appeared to be two photographs of a genital area, the affidavit alleged.
“When I accessed Google Chrome on the cell phone, there were multiple pornography sites that appeared,” one an adult porn site, one a homosexual porn site, multiple sites of what appeared to be animated pornography of young children doing obscene acts, and multiple sites to view and chat about child pornography, Danker alleged in his affidavit.
“Since these site were accessed through Google Chrome and I know Google Chrome can be installed on home computers, laptops and tablets, I requested a search warrant” for Winnie’s residence, Danker wrote in his affidavit.
The Perkins investigator wrote that he took Winnie’s cell phone to the Stillwater Police Department where Detective Inspector Greg Miller took possession of the phone to analyze information from it and made two CDs containing the extracted information, the affidavit said.
When the Perkins investigator viewed those CDs, he saw young boys, along with animated photographic images of obscene material depicting young children performing sex acts on each other, the affidavit alleged.
The Perkins investigator also saw two photographs of the boy’s genital area, the affidavit alleged.
