(Stillwater, Okla.) — A Perkins man accused of breaking into a couple’s house in Perkins where medical marijuana plants and a gun were reportedly stolen has been ordered to appear in court with an attorney on Sept. 15 on a felony second-degree burglary charge.
Deven Ray Lewis, 20, could be given as much as seven-year prison term and a $10,000 fine if convicted. Lewis remains free on $10,000 bail, court records show.
The victims said they returned from vacation to find their home burglarized on June 26, Perkins Police Officer Billy Laster wrote in an affidavit.
“They reported a Taurus .380 pistol and nine medical marijuana plant taken from their home. They believed Deven Lewis took the items because he knew where the gun was stored,” the affidavit alleged.
The male owner “believed that the suspect entered through the back door of the home, as it is the easiest door to get into,” the affidavit said. The male owner said the suspect possibly kicked an interior door open where he was storing his marijuana plants, the affidavit said.
Perkins Police Officer Jason Thompson noticed pry and scratch marks on the back door and saw that the locked interior door was forcibly opened due to damage, the affidavit said.
After the couple contacted a relative of Lewis via Facebook Messenger, “The pistol and marijuana plants, which were now dead, were (returned) in the bed of a black pickup parked on the property,” the affidavit alleged.
No fingerprints were lifted from the pistol from which the serial number had been obliterated, the affidavit said. The male owner said that the serial number was on the gun before the burglary, the affidavit said.
The male owner estimated that the marijuana plants were worth $900 and the gun was worth $250, the affidavit said.
In a recorded phone call on June 27 with Officer Laster, “Deven Lewis admitted to taking the gun and marijuana plants. However, he said the gun and plants were left outside,” the affidavit alleged.
“He said he took the gun because he was worried,” about the female owner’s safety, the affidavit alleged. “He said he took the marijuana to consume,” on June 19, the affidavit alleged.
Lewis “denied removing the serial number from the gun,” the affidavit said.
