(Stillwater) — A Pawnee man has pleaded guilty to possessing a vehicle stolen in Pawnee, obstructing a Cushing police officer, leaving the scene of an accident involving damage in Cushing and driving without a license, all in Payne County.
James Dylan Gonzales, 21, who had been jailed for the past six weeks, was released Friday by Associate District Judge Stephen Kistler under the Delayed Sentencing Program for Youthful Offenders and ordered to return to court Oct. 9 for sentencing.
Gonzales was arrested in Cushing five hours after the vehicle was reported stolen to Pawnee police on Dec. 7, according to an affidavit by Cushing Police Officer Adam Harp.
Gonzales fled the scene of an accident involving the stolen vehicle that morning in Cushing and gave a false name to police when he was later located at a Cushing residence, the affidavit said.
The owner of a 2000 Pontiac, Whitney Nuttle of Pawnee, spoke to Cushing police by phone about 5:30 p.m. Dec. 7 and said that she last saw her car at about 3 a.m. that day, the affidavit said.
“Nuttle said that she turned off her Christmas lights and that the vehicle was still at her house. Nuttle said that she reported the vehicle stolen to the Pawnee Police Department around 11 a.m. this morning,” the affidavit said.
Nuttle said that she noticed that her spare key to the car was missing from her house, the affidavit said.
Nuttle told Cushing police that she believed James “JD” Gonzales took her vehicle, the affidavit said.
She said that she had not given him permission to use her vehicle, the affidavit said.
Gonzales appeared to be intoxicated when he was interviewed by the Cushing officer, the affidavit said.
Two years ago in Payne County, Gonzales pleaded guilty to possession of marijuana, public intoxication and being a minor drinking beer in a public place, all in Stillwater in January 2006.
In that three-count misdemeanor case, Gonzales received probation, which he is alleged to have violated by failing to show proof of counseling as required by a court-ordered drug and alcohol evaluation, records show.
