(Cushing, Okla.) The following information is a preliminary collision report furnished by the Department of Public Safety.

An incident occurred on Thursday, June 11th at 1:49 (pm) on US412 about 200ft east of Leroy Rd. which is located approximately 2.5 miles east of Westport in Pawnee County.

David Burnes (50) of Pawnee was driving a 1996 Navistar 4700 Dump truck while Jerald Warden (53) of Maramec directed Burnes where to off load asphalt into a sink hole when a bungee cord securing a stop sign in the bed of the Dump truck broke, causing the stop sign to fall and strike the Warden in the neck.

Burnes was not injured and Warden was transported by Mercy EMS to Saint Johns (Tulsa) in critical condition with head injury. Warden expired at the hospital at 3:02 (pm).

The DPS report shows the cause of the incident to be a shifting or falling object.
