(Stillwater, Okla.) — An out-of-state man who was originally accused of having oral sex with an underage female relative at her rural Cushing residence has admitted using his cell phone to send and receive lewd photographs between Dec. 26, 2012, and Aug. 1, 2013.
After the prosecution dismissed a forcible oral sodomy charge against him on Friday, Joshua Seth Shanks, 24, of Pearl City, MS, pleaded guilty to a reduced charge of using access to computers to violate Oklahoma law.
As part of a plea bargain for a three-year deferred sentence, Shanks was ordered to have no contact with anyone under the age of 20 via social media, to undergo 16 sessions of individual counseling, and to perform 100 hours of community service within 12 months.
Shanks also was fined $1,000 and ordered to pay $250 to the victims’ compensation fund by Associate District Judge Stephen Kistler Friday.
Last August, the girl’s father reported to the Payne County Sheriff’s Department that his underage daughter had been having sexual relations with Shanks, Sheriff’s Investigator Larry Kitchel alleged in an affidavit.
The father “said he had found out and realized the two (defendant and juvenile) had been exchanging lewd texts and pictures with each other,” the affidavit alleged.
The father said the juvenile “told him that the two did everything but intercourse,” the affidavit alleged.
During an interview at the Saville Center in Stillwater, the girl told a forensic interviewer that Shanks had stayed at her home in rural Cushing in December 2012, the affidavit said.
While the girl and Shanks, to whom she is related, were watching movies in the garage area where Shanks was staying, she performed oral sex on him, the affidavit alleged.
“Juvenile went on to say she sent pics by her phone to the defendant after he had returned to Mississippi,” with her underpants on and without any clothes, the affidavit alleged.
