STILLWATER — A 51-year-old Pawnee County man has been ordered held in the Payne County Jail on $5,000 bail on a felony charge of throwing an open beer can at a moving Stillwater police car shortly before 1 am on March 22.
David Wayne Ferguson of Cleveland, who has been scheduled to appear in court this week, could be given as much as a 10-year prison term and $10,000 fine if convicted of throwing an object at a moving vehicle.
Stillwater Police Officer Christopher Boren was responding to a possible domestic incident in the 2300 block of S. Walnut when he was advised “that the suspect had left in a white Chevy Impala heading westbound on 19th,” an affidavit alleged.
“I observed a white Chevy Impala rounding the corner from Walnut to 19th heading westbound. When our vehicles passed one another, I observed David throw an object out of the driver’s side window of the white Impala. The item struck my patrol unit directly above the windshield on the driver’s side.
“The item thrown was a beer can that I estimate at the time it was thrown to be at least half full. Officers stopped the vehicle due to him throwing and striking my vehicle.
“I drove to where they had David detained. As soon as he saw me, he apologized for throwing the beer can,” Officer Boren alleged in his affidavit.
“I requested that the officers that had David detained inform him that he was under arrest and requested they transport him on my behalf.
“I then drove to the location of the original call. After speaking with the other individuals involved, I found that no other crime had been committed,” Officer Boren wrote in his affidavit.
