(Stillwater, Okla.) — An ex-convict accused of having raped his cellmate in the Cimarron Correctional Facility in Cushing has been ordered to appear in court on Sept. 26.

Raul A. Salcedo, 23, was scheduled to be in Payne County District Court on Friday for trial court arraignment on the rape charge, but he did not appear.

Defense attorney Mark Bailey told the judge Friday that Salcedo is in the Texas County Jail — where he is being held for a probation revocation hearing, court records show.

Salcedo was convicted two years ago of drunk driving and concealing stolen property in Texas County — for which he was incarcerated until five months ago when he began serving the probationary part of his sentences.

While Salcedo was being held in the private prison in Cushing, he allegedly anally raped his cellmate last September, court records show.

The alleged incident was investigated by Oklahoma Department of Corrections Internal Affairs Agent Randy Knight, court records show.

Salcedo admitted to performing a sexual act with his cellmate, but claimed that it was consensual, Knight alleged in an affidavit.

If convicted of first-degree rape by force or fear, Salcedo could be sentenced to 20 years to life in prison, court records show.
