(Stillwater, Okla.) — A 32-year-old man, who was convicted of domestic violence in Texas in 2015, has been accused of attacking his ex-girlfriend in a shed outside her rural Agra residence in Payne County.
Kyle Marcus Carter, who previously lived in Arkansas but was listed as homeless on Payne County court documents, has been jailed on $20,000 bail pending his arraignment this afternoon on a felony charge of domestic assault and battery as a second offense.
Payne County Sheriff’s Deputy Scott Hopper was sent on March 9 to the residence of Carter’s ex-girlfriend, who lived on S. Rockview Drive in rural Agra with a female roommate, according to his affidavit.
The deputy wrote in his affidavit, “I could see that her nose appeared to be swollen and I could see bruising around both of her eyes. I also observed red marks on (her) neck.”
Carter’s ex-girlfriend said on the previous night, she was in a recliner in the shed in the front yard of her residence when Carter was upset, came into the shed, and dragged her off of the recliner onto the floor, the affidavit alleged.
“She goes on to say that she tried to get away from Kyle, but he cornered her in the shed,” the affidavit alleged.
She said “he (Kyle) pushed her down, then got on top of her placing one of his knees into her stomach,” the affidavit alleged.
She said “once she was on the ground with Kyle on top of her, he punched her several times in the face and head area with a closed fist,” the affidavit alleged.
She said that when she yelled for help, her female roommate came into the shed and “Kyle stopped hitting her and he got up,” so she ran out of the shed, the affidavit alleged.
Her female roommate said that on March 8 at 9:30 pm, she was in the trailer and heard the victim calling for help, “so she ran out of the house to the shed to see what was going on,” the affidavit alleged.
She said that as she went into the shed, she saw the victim on the floor “with Kyle on top of her with his knee on her stomach,” the affidavit alleged.
She said “Kyle had one arm raised in the air with a closed fist in a hitting stance,” the affidavit alleged.
She said “after she came into the shed, Kyle saw her, then got up, and let (his ex-girlfriend) go,” the affidavit alleged.
If convicted of the Payne County charge of domestic assault and battery as a second offense, Carter could be given as much as a four-year prison term.
Carter had been convicted six years ago of assault causing bodily injury to a family member in Tarrant County, Texas, and sentenced to 25 days, court records show.
