(Stillwater, Okla.) — A 45-year-old man, who waived extradition from Texas, was placed in the Payne County Jail on Tuesday after he pleaded no contest to forcible oral sodomy of a 5-year-old female relative on July 1, 2017, when he lived in Cushing, a court official told KUSH today.

Wuilfrido Hernal Castillo was sentenced Tuesday to 20 years of probation except 90 days in jail by Payne County Associate District Judge Stephen Kistler, who ordered him to register as a sex offender for life and provide a DNA sample.

Castillo wants to move back to Texas when he is released from the Payne County Jail, a court official told KUSH today.

Assistant District Attorney Debra Vincent told KUSH this afternoon in an email, “This was a plea agreement.”

She explained, “Prosecuting child sexual abuse always requires us to weigh the need for proper punishment of offenders against the potential negative consequences for a child in going through the public court process.

“In this case, after conferring with the child’s non-offending family members about her present emotional stability, we chose the child’s well-being and the certainty of a negotiated agreement over the risks of testifying again in front of a jury trial would present to her well-being.”

According to an affidavit, Castillo left a residence shortly after Cushing Police Officer Brad Kastl arrived to talk to the girl’s mother on July 1, 2017.

The mother said that her 5-year-old daughter made a disclosure earlier that day after the mother awoke from napping with her 3-year-old daughter, the affidavit said.

The mother said that her 5-year-old “was seeing a counselor because for the last two years, she performed ‘sexual acts’ on her teddy bears,” and acted inappropriately with her little sister, the affidavit said.

The mother said that the 5-year-old girl got very upset any time she was left alone with Castillo, the affidavit said.

During a forensic interview at the Saville Center in Stillwater on July 3, 2017, the 5-year-old made no disclosure of sexual abuse, the affidavit said.

But after the girl was examined by a registered nurse, she made disclosures to the nurse, the affidavit said.

The girl said that she and Castillo “had secrets,” the affidavit said.

Three days later, the girl’s mother said that while she was reading books from the Saville Center to the 5-year-old about proper and inappropriate touches, the girl said that Castillo did those things to her in Texas previously, the affidavit alleged.

The 5-year-old said that Castillo “also did these things to her little sister,” who was not forensically interviewed due to her age, the affidavit alleged.

The 5-year-old continued to see a counselor and made further disclosures about sexual abuse, the affidavit said. A state Department of Human Services worker said that the girl also made disclosures to her foster parent, the affidavit alleged.

“Due to this information, a second forensic interview at the Saville Center was scheduled,” for the 5-year-old in October of 2017, which the Cushing officer attended, the affidavit said.

In addition to describing incidents involving herself, the 5-year-old said that Castillo made her 3-year-old sister perform oral sex on him, the affidavit alleged.

The Cushing officer said that he was not able to interview Castillo about the allegations of sexual abuse, since he could not locate him, the affidavit said.

The girls’ mother “provided information indicating Castillo had fled from Oklahoma to Odessa, Texas,” where he was arrested on Nov. 21, 2017, court records show.
