(Stillwater, Okla.) — An ex-convict from Tryon has been sentenced to four years in prison followed by eight years of probation for possessing methamphetamine and fentanyl with intent to distribute in Stillwater, as part of a plea bargain approved in court last week.
At the time of his latest arrest, Kyle Jacob Munier, 32, was serving the probationary part of his 2019 sentences for car theft and being a felon in possession of a firearm, which were revoked concurrently to four years in prison last week by Payne County Associate District Judge Michael Kulling.
Before Munier pleaded guilty to his Stillwater drug charge along with misdemeanor counts of drug paraphernalia and resisting arrest, his 2023 felony charges of domestic violence and violating a protective order in Glencoe had been dropped by the prosecution two weeks earlier, court records show.
In his latest case, Stillwater Police Officer Byron Goree was investigating a report of a suspicious man checking car door handles, who was entering a business complex on N. Perkins Rd. at about 7 pm on March 6, an affidavit said.
When the officer asked to speak to Munier, “His nervous behavior and excessive sweating raised my suspicion,” Goree wrote in his affidavit.
After learning that Munier had outstanding arrest warrants for domestic violence in Payne County and being a felon in possession of a gun in Lincoln County, three detectives arrived to assist, Goree wrote in his affidavit.
“Upon searching Kyle (Munier), Officers Knox and McSpadden discovered a blue container/baggy containing several small packages of a clear crystalline substance, later confirmed to be methamphetamine. Detective Carson and Detective Moore found additional drug-related items in Kyle’s backpack, prompting us to collect all evidence for further examination in a more controlled environment,” at the police department, Goree wrote in his affidavit.
Police found in Munier’s backpack “various drug paraphernalia items, marijuana, edible gummies, vape cartridges containing marijuana, and unidentified pills that were submitted to OSBI for testing. Additionally, three baggies containing a white powder substance,” one of which tested as fentanyl, the affidavit said.
“In Kyle’s wallet, I found his identification card, contradicting his earlier claim of not having one, along with $273. in US. currency,” Goree wrote in his affidavit.
According to the state Department of Corrections and court records, Munier, who had been released from prison in December of 2022, was previously convicted of:
* manufacture of methamphetamine in Payne County in 2010 and possession of the same drug in Perkins in 2015, for which he was originally placed on probation for 10 years with Drug Court, but after being terminated in 2016, given a seven-year prison term with the balance suspended on completion of the Bill Johnson Drug Offender Work Camp;
* assault with intent to commit a felony in Lincoln County in 2019, for which he was given a five-year prison term and being a felon in possession of a firearm in Tryon, for which he was given a six-year prison term in 2020, but served only two and one-half years, followed by four years of probation;
* car theft and being a felon in possession of a firearm in 2019 in Payne County, for which he was given the above concurrent sentences of six years in prison followed by four years of probation.
