Drumright man jailed on rape charges
(Stillwater, Okla.) — A Drumright man was arraigned Friday on two counts of having sex with an underage Drumright girl at her relative’s residence in Cushing and a count of making a lewd proposal to another underage girl to join him in sex with her, all on Feb. 5.
Richard John Andrew De Ruyter II, who turns 20 on Wednesday, remains in the Payne County Jail on $20,000 bail on the three-count felony charge, a sheriff’s spokesman told KUSH Monday.
If convicted of second-degree rape by instrumentation of the girl’s anus, De Ruyter could be sentenced to life in prison without parole.
If convicted of a count of second-degree rape by sexual intercourse, De Ruyter could be given a 15-year prison term.
If convicted of an additional count alleging he asked another underage girl to come into the bathroom and join him in sex with the underage girl, De Ruyter could be given a 20-year prison term.
Cushing Police Detective Adam Harp wrote in an affidavit that on Feb. 6, a woman came to the police station to report that her 14-year-old daughter had consensual intercourse with 19-year-old De Ruyter “last night at a residence in Cushing.”
When the Drumright girl was asked how she knew De Ruyter, “she said she met him through her older brother and her ex-boyfriend,” the affidavit alleged.
“She said that she speaks with him a lot via cell phone by text messages and calling him,” the affidavit alleged. She said that he called her a lot when he was upset about his mother who is ill, the affidavit alleged.
She said that he wanted her to be his girlfriend, but that she did not, the affidavit alleged.
She said that when she texted him, he asked her where she was and she told him she was at a relative’s house in Cushing, the affidavit alleged.
She said that “Ricky needed to talk to her because he was upset over his mother possibly going to die and couldn’t handle it and said that if he loses her that he was going to kill himself and needed to talk to someone,” the affidavit alleged.
She said that when he arrived at the Cushing house at about 1 a.m., “she asked Ricky why he came over to the house and he said that he needed to talk to her and cuddle,” the affidavit alleged.
She said that when he came into the house, a roommate of her relative told him that he needed to leave, the affidavit alleged.
She said that he left for about 20 minutes but then came back into the house and told her that he really needed to talk to her, the affidavit alleged.
The girl said that she told him she did not want to get into trouble for his being at the house, “and he said that he would be quiet and that’s when the touching started,” the affidavit alleged.
She said that after a sexual act, she went into the bathroom and he told her that he had asked another underage girl “if she wanted to join them in the bathroom and if it was okay with her and she said no because (that girl) was still a virgin,” the affidavit alleged.
She said that after they had intercourse, “Ricky left the residence and later told her that he didn’t want to get into trouble and that he was going to date someone his own age,” the affidavit alleged.
“She said that he stopped having sex with her because he did not want to get her pregnant and be in any more trouble,” the affidavit alleged.
She said that she had not had sex with him before that incident, “but that he has talked about it with her about a month prior to this incident,” the affidavit alleged.
She said “Ricky had told her that he knew that he could get into trouble for having sex with her because of her age,” the affidavit alleged.
She said that he knew she was 14 and that the sex between them was consensual, the affidavit alleged.
The other girl at the house, who is 15, said she was asleep when she woke up and noticed that the two were sitting in a chair, the affidavit alleged.
She said when she asked him what he was doing there, he said he was there to see the 14-year-old girl, the affidavit alleged.
She said that before he and the 14-year-old girl went into the bathroom, “he asked her if she wanted to join them having sex in the bathroom and she said no,” the affidavit alleged.
When De Ruyter was interviewed that same night at the Drumright police station, he admitted that he was at the house in Cushing, the affidavit alleged.
He said he and the 14-year-old girl had sex in the garage, but he denied that anything happened in the bathroom or asking the other girl to join them in sex, the affidavit alleged.
He said he thought the girl was 15, “but knew she was too young,” the affidavit alleged.
“Ricky said that he is currently seeking sex therapy in Tulsa, Oklahoma, because he is addicted to sex,” the affidavit alleged.
