(Stillwater, Okla.) — An ex-convict from Drumright, who was released from prison four years ago, has been jailed in Payne County on $25,000 bail on charges of possessing a stolen truck and marijuana in rural Stillwater.

Bryan Matthew Carroll, 30, who is also being held for Creek County authorities, has been ordered to appear in court Tuesday with an attorney to represent him on his Payne County charges.

Carroll was arrested shortly before 5 p.m. on Oct. 19 in the 9200 block of N. Western in rural Stillwater, according to an affidavit by Payne County Sheriff’s Deputy Chris McKosato.

The deputy had been dispatched to the area of Western Road north of Glencoe Road on a report of a suspicious person in rural Payne County, the affidavit said.

The reporting party said that “the subject left the area and was seen walking west into a wooded area and a small white car followed behind moments later,” the affidavit said.

“The reporting party described a white male with tattoos on his face and wearing a hat sideways — needing to use a phone because his car was broken down,” the affidavit said.

Carroll approached the deputy and said that his truck was having issues, the affidavit said. “I noticed three other individuals standing by the truck and another white small passenger car,” the deputy wrote in his affidavit.

“As I was speaking to Carroll, I was notified by dispatch the vehicle’s tag returned as stolen,” the deputy wrote in his affidavit.

After “I told Carroll he was in investigative detention because the truck returned stolen, Carroll immediately told me the truck belonged to his uncle,” the deputy wrote in his affidavit.

While the deputy was verifying the vehicle’s identification number, he noticed a plastic bag with a green leafy substance, which subsequently tested positive as marijuana, and also two pill bottles on top of the center console, the affidavit alleged.

As the deputy was waiting for a dispatcher to advise him if any of the individuals present had outstanding warrants, “Carroll told me he borrowed his uncle’s truck,” the affidavit said.

“I asked Carroll why he would think his uncle would report it stolen…Carroll said he had permission,” but the deputy was told that the victim wanted the truck towed due to its being stolen, the affidavit alleged.

“Carroll said he was responsible for anything found in the truck. I asked Carroll if it was his and told him I didn’t want him taking the rap for someone else’s items, and he said, ‘I borrowed the truck so I’m the one responsible,"” the affidavit alleged.

“I was notified by dispatch Carroll had several outstanding warrants through Creek County,” the deputy wrote in his affidavit.

“Carroll said he knew about the warrants. I released the other subjects,” the deputy wrote in his affidavit.

Regarding the pills, which were verified as prescription only and non-scheduled drugs, “Carroll said he found the bottles in one of the residences and decided to keep them,” the affidavit alleged.

According to state Department of Corrections records, Carroll was convicted in 2009 of assault and battery on a detention officer in Payne County, for which he was given a four-year prison term, but only served about 15 months.

Carroll had also been convicted in 2008 of stealing a motor vehicle in 2004 in Payne County, for which he was given a seven-year sentence, but only served about two and one-half years, DOC records show.

Carroll had also been convicted in 2008 of possession of a controlled substance with intent to distribute in 2004 in Payne County, for which he was given a seven-year sentence, but only served about two and one-half years, DOC records show.

Carroll had also been convicted in 2004 of assault and battery with a dangerous weapon in Drumright, for which he was given a one-year sentence that was apparently dismissed on appeal, court records show.

Carroll had also been convicted in 2005 of assault and battery with a dangerous weapon and unauthorized use of a motor vehicle in Drumright, for which he was given a three-year prison term, but only served about seven months, DOC records show.

At the time of his latest arrest, Carroll was being sought on a Drumright felony charge of domestic assault and battery that was filed on Oct. 8, court records show.

Carroll was also being sought on a misdemeanor charge of assault and battery in Drumright that was filed Sept. 30, court records show.

Carroll also had outstanding arrest warrants for failure to pay court costs in two 2004 charges in Drumright of assault and battery with a dangerous weapon, court records show.
