(Stillwater, Okla.) — A 42-year-old man accused of sexually battering a female bartender while she was the only employee in the Stillwater establishment has been ordered to appear in court on Jan. 9 with an attorney on a felony charge.
If convicted of sexual battery, Matthew James McCubbin of Stillwater, who remains free on $20,000 bail, could be given as much as a 10-year prison term, according to court documents filed last month.
Stillwater Police Detective Richard Alley was sent at 11:48 am on Sept. 10, 2024, to the bar where he was shown a video of McCubbin sexually assaulting the bartender the previous evening, his affidavit alleged.
“I watched approximately four minutes of the surveillance video,” which he was told was at least an hour long, the detective alleged in his affidavit.
“I saw McCubbin enter the employee area behind the bar and slap (the bartender’s) buttocks several times. He also tried to put his hand under the back of her shirt. At one point, McCubbin was behind the bar and looked like he grabbed (her) hand while pulling the front of his shorts down with the other,” the detective alleged in his affidavit.
The bartender said, “she felt like she could not call police at the time because she was the only employee working at the time and felt like she had to keep McCubbin from becoming belligerent and violent,” the affidavit alleged.
The next day, a male witness, who said he was in the bar when McCubbin sexually assaulted the bartender, talked to the detective at the Stillwater Police Department, the affidavit alleged.
The witness said, “he was in the bar when Matt and one or two other guys walked in. (He) thought Matt was already intoxicated. (He) said he saw Matt ‘smack her on the butt’ over the course of an hour. (He) said Matt escalated to making sexual comments to (her) but could not remember exact quotes. (He) said he texted her and asked if she wanted him to intervene or at least stick around due to Matt’s inappropriate behavior,” the affidavit alleged.
“(She) welcomed him to stay and hang around for the time being. (He) said within the next 30 minutes, Matt escalated to some type of foot fetish. (He) said Matt asked (her) for her hand while she was doing something behind the bar. (He) figured she thought he was going to pay for drinks, so she stuck her hand out. (He) said (she) pulled away from Matt as if revolted or disgusted,” the affidavit alleged.
