(Stillwater, Okla.) — A Cushing woman — jailed on $25,000 bail — was charged today with having possessed methamphetamine on Monday in a case investigated by Iowa Tribal Police and Cimarron Casino staff in Perkins.
If convicted of her latest drug charge, Melissa Baker, 48, could be sentenced to 20 years in prison and fined $10,000, court records show.
Eleven months ago, Baker, who had admitted possessing prescription pain medication two months after she was placed on probation for kicking a Cushing police officer, was given a five-year suspended sentence with extensive conditions.
Last November in addition to serving 10 days in jail, Baker was ordered to have quarterly hair follicle tests, random urine analysis tests and a substance abuse evaluation along with performing any recommended follow-up.
She had been arrested at 2:16 a.m. on April 6, 2013, in the parking lot of the Kum and Go convenience store in Cushing by Payne County Sheriff’s Deputy Nick Myers, court records show.
“I asked Mrs. Baker if she had any illegal items on her person or inside her vehicle, and she advised, ‘no, you can look,"” the deputy wrote in his affidavit.
Inside her purse in the vehicle, the deputy found two pills identified as the prescription narcotic Soma, the affidavit said.
“Mrs. Baker advised she received the pills from a friend and they are a muscle relaxer or pain pill,” the affidavit said.
Two months earlier, Baker had been placed on three years’ probation except five days in jail and fined $500 for kicking Cushing Police Officer Rachel Hentges.
The officer had been sent at 7:40 p.m. April 2, 2012, to the 1500 block of E. Main Street about “an individual who was walking in and out of traffic and displaying vulgar hand gestures toward passing motorists,” according to Hentges’ affidavit.
After Baker was arrested for public intoxication, she became belligerent and combative during the booking process, the affidavit said.
“Baker looked at me, stated, ‘F… you, b….’ and lunged toward me. Baker was still restrained by handcuffs at this time,” the officer wrote in her affidavit.
“Baker was pushed up against the book-in counter. As Baker was being held against the counter, she kicked her right leg out toward me and struck me in the left shin.
“Baker kicked me a second time as she was being restrained. The second kick struck me in the right thigh,” the officer wrote in her affidavit.
For violating her probation in that case, Baker was given a concurrent 10-day jail term last November, court records show.
