(Stillwater) — A Cushing teenager has been ordered to appear in court Monday on charges of raping a 12-year-old girl and inducing a 13-year-old girl to perform a lewd act on him in alleged incidents in March — four days apart in Cushing.

Nathan Dale Scott, 16, also was a suspect in a Cushing sexual assault investigation in November involving a 15-year-old girl with behavioral problems, according to court documents.

Scott was ordered held on $50,000 total bail after the alleged March incidents came to light. He was transported to the Sac and Fox Detention Center in Stroud by Cushing Police Chief Terry Brannon, court records show.

Since Scott, who turns 17 in May, was charged as a youthful offender rather than a juvenile, his court documents regarding the alleged crimes are open to the public.

Scott can ask for a preliminary hearing Monday on charges of second-degree rape of the 12-year-old Cushing girl on March 12 and lewd proposal/acts toward a 13-year-old Cushing girl on March 16.

Under a new youthful offender law that went into effect in June, if convicted of either charge, Scott could be placed in the custody of the Office of Juvenile Affairs until he is 18 years and five months.

At that age, Scott would be returned to Payne County District Court to appear before a judge to determine whether he should be sent to an adult prsion, given probation or released from custody.

Scott was arrested on March 17 five hours after Cushing Police Officer Justin Sappington was sent to Cushing Regional Hospital regarding a 12-year-old rape victim, according to court documents.

The 12-year-old girl, who had been taken to the emergency room by her parents, told her mother that she did not have sex with Scott that day — but said that she did have sex with Scott on March 12, which she said was consensual.

When Scott was questioned by the Cushing police officer, Scott said “he had been up for about two days with only approximately 30 minutes of sleep,” on March 12 and “really didn’t remember what all went on that night because he was sleep-deprived,” according to Sappington’s affidavit.

Scott said that when a male friend told him the next morning that Scott had sex with a 12-year-old, Scott said “he started freaking out and did not remember anything about the night before,” the affidavit said.

Scott said he was not under the influence of any type of intoxicants, the affidavit said.

When asked if he knew that the girl was underage, Scott “told me that he thought that she was like 15 or 16 years old,” Sappington wrote in his affidavit.

That alleged March 12 incident came to light on March 17 when a Cushing woman learned that her young son, the 12-year-old girl and Scott were at Scott’s house, the affidavit said.

The woman told police that she went to Scott’s house to pick them up and found Scott and the girl in the shower together without any clothes on, the affidavit alleged.

The woman said she told the girl to get dressed and come with her, the affidavit said. The woman then took the 12-year-old girl back to her father and told him that she had found the girl in the shower with Scott, the affidavit said.

The woman told police that she just found out that the 12-year-old girl and Scott had sex in her own house on March 12, the affidavit alleged.

When her son was questioned, he said that Scott and the 12-year-old girl “had gone into his bedroom and had sex,” on March 12, the affidavit alleged.

He said he did not see them, but that Scott had told him about it, the affidavit alleged.

He said that Scott did not seem intoxicated or tired at the time, the affidavit alleged.

The day after Scott was arrested, the parents of a 13-year-old girl brought her to the police department, Sappington wrote in another affidavit.

The girl’s mother said that her daughter hadn’t been acting the same lately and she believed that her daughter might have been sexually assaulted by Scott, the affidavit said.

The girl was extremely distraught and crying while she was in the lobby of the police department, the affidavit said.

The girl told the officer that on March 16 she was walking around Cushing with friends when they all ended up by the high school and stopped at a table on the school campus, the affidavit said.

She said that Scott approached her and started talking to her about sex, the affidavit said.

The girl said that she told Scott that she was a virgin and didn’t want to have sex, the affidavit said.

She said that Scott told her that “he lost his virginity when he was 7-years-old to a baby sitter,” the affidavit said.

She said that this was her virginity and she walked away, but Scott followed her, the affidavit said.

She said that Scott kept asking her to fondle him, which she finally did, the affidavit alleged.

She was sobbing when she told that to the police officer, the affidavit said.
