(Stillwater, Okla.) – A Cushing motorcyclist accused of attempting to elude a sheriff’s deputy on Highway 33 by accelerating up to 135 mph has been ordered to appear in court this afternoon on a felony charge that carries as much as a five-year prison term and a $5,000 fine on conviction.
    Brian Dale Smith, 28, remains free on $5,000 bail, court records show.
    Payne County Sheriff’s Deputy Nick Myers wrote in an affidavit that at 12:08 a.m. on Oct. 10, 2015, he was traveling east on Highway 33 west of Harmony Road in Cushing when he saw a “sport-type motorcycle pull out of the Kum and Go convenience store located at 2001 E. Main.”
    “The motorcycle rapidly accelerated to a speed greater than reasonable and proper. I was traveling at the posted speed limit of 35 mph and the motorcycle was pulling away.
    “As I approached Harmony Road, I activated my emergency lights to perform a traffic stop on the vehicle.
    “At this intersection, my speed was at 100 mph and the motorcycle was still pulling away,” the deputy alleged in his affidavit.
    “Shortly after the intersection, I activated my audible siren,” and further pursued the driver, the deputy wrote in his affidavit.
    “Mr. Smith continued to increase speed while passing several vehicles.
    “Mr. Smith continued an additional five and a half miles at speed reaching 135 mph,” the affidavit alleged.
    “Mr. Smith then activated his turn signal indicating to turn north on Chronister Road.
    “Mr. Smith then stopped in the middle of the divided four-lane highway and placed his hands in the air.
    “I exited my patrol car and placed Mr. Smith under arrest,” the deputy wrote in his affidavit.
