(Stillwater, Okla.) — A 46-year-old Cushing man with a criminal record in three counties has been jailed on $15,000 bail pending an April 3 court appearance on a charge of breaking into a house in Cushing.
Due to his multiple prior felony convictions, Brandon Hoyt Pershall could be given a prison term of 20 years to life if convicted of second-degree burglary.
In his latest case, Pershall was arrested shortly before 11 pm on Feb. 28 near the Cushing High School fieldhouse by Cushing Police Officer Garvis Scott Thomas.
Cushing police had been sent about 30 minutes earlier to the 800 block of S. Holmes Ave. on a report of a man attempting to break into a house, an affidavit said.
The reporting party, who was not at his house, emailed officers a picture from his residence’s security camera in which Pershall was identified, the affidavit alleged.
“I informed Pershall that I have seen the camera footage,” the officer wrote in his affidavit.
“Pershall advised he went to the address because he was told his father purchased the house for him. Pershall advised he has not spoken with his father, who lives in Texas, but he was told by his sister about the residence,” the affidavit alleged.
“I showed the footage to Pershall and asked how that looks, and he admitted it appears he was trying to break into the residence,” the officer alleged in his affidavit.
According to court records and the state Department of Corrections, Pershall has a 20-year criminal record consisting of prior convictions for:
* drunk driving in Payne County for which he was given a five-year prison term in 2003 of which he served two years;
* assault and battery on a police officer in Payne County for which he was given a concurrent sentence in 2003:
* assault and battery with a dangerous weapon in Payne County for which he was given a concurrent sentence in 2003;
* drunk driving in Pottawatomie County for which he was given a concurrent sentence in 2003;
* two counts of assault and battery with a weapon in Pottawatomie County for which he was given two concurrent sentences in 2003;
* domestic abuse by strangulation in Payne County for which he was given three years of probation in 2010;
* drunk driving in Creek County for which he was given two years of probation in 2013.
