(Stillwater, Okla.) – A Cushing man was charged Monday with possessing marijuana with intent to distribute in a case investigated by Payne County Sheriff’s Deputy Scott Hopper.
Kyle Logan Phillips-Hutchison, 21, was arrested at 2 a.m. on June 16 after being spotted in an SUV in front of an empty house at Moses and Depot Streets in Cushing, according to an affidavit.
Phillips-Hutchison remains free on $5,000 bond pending his arraignment on Tuesday, court records show.
When the deputy asked Phillips-Hutchison why he and his passenger were sitting in front of an empty house, the defendant said that his passenger “asked him to stop so he could get the phone number off the for-rent sign,” the affidavit alleged.
The deputy told him that 1 a.m. was an odd time to be out looking at houses, but Phillips-Hutchison said that they just came from a friend’s house and his passenger asked him to stop, the affidavit alleged.
“As I was talking to Kyle (Phillips-Hutchison) and giving him his ID back, I caught a smell coming from the vehicle,” that he recognized as marijuana, the deputy alleged in his affidavit.
After Phillips-Hutchison and his passenger said there was no marijuana in the vehicle, a Cushing officer arrived and also smelled it, the affidavit alleged.
“I asked again if there was anything in the car and Kyle stated yes and that there was some marijuana in the back seat,” in a red case, the deputy alleged in his affidavit.
Phillips-Hutchison said that the marijuana, which weighed 14.6 grams, was his and not his passenger’s, the affidavit alleged.
