(Stillwater, Okla.) — A Cushing man accused of pointing a gun at a male neighbor and making threatening statements has been ordered to appear in court on Aug. 3 with an attorney for arraignment on a felony charge.

Jonathon Wayne Hice, 42, remains free on $3,500 bail on a charge of feloniously pointing a firearm, which carries a prison term of one to 10 years on conviction.

Hice was arrested at 7:59 pm on July 3 in the 1200 block of E. 5th Street by Cushing Police Officer Garvis Scott Thomas, court records show.

When the officer contacted Hice at 7:39 pm, he walked out of his residence with his hands in the air, the affidavit alleged.

“Hice was crying and breathing hard and was physically upset.

“Hice stated on Thursday July 1, 2021, he was on his front porch when the ‘girl’ came outside her residence and was looking for her dog. Hice explained he whistled and pointed towards the corner of her house indicating the dog was there.

“Hice advised the girl looked at him and then went inside her residence and a male came outside with her. Hice then stated, ‘that girl probably thought I was whistling at her and went and got him.’ Hice informed me he was only whistling at her to let her know where the dog was,” the officer wrote in his affidavit.

“Hice explained that today (July 3) two of the girls from (that house) came to his residence and ‘cussed out’ his 24-year-old daughter,” the affidavit alleged.

“Hice informed me he arrived at the residence today (July 3) and an argument began between him and his neighbors. Hice advised they started calling him a pedophile because he was whistling at the girl.

“Hice further advised multiple people started walking towards him and one male took his shirt off. I asked Hice if the males were on his property, and he stated they were in their front yard and believed one of the males may have been in the street.

“Hice explained he then went inside and retrieved his pistol and walked back outside because of the amount of people that were out there. Hice advised he never pointed the pistol at them, but did show them he had one.

“Hice further advised he then took the pistol, with the barrel facing him, and started to tell them if he was a pedophile, then he deserved to be shot. When I asked Hice again if he pointed the firearm at them, he said ‘no,"” the Cushing officer wrote in his affidavit.

When the officer made contact with one of the men, he “showed me the video on the phone that showed Hice pointing the firearm at them. On the video, Hice then turns the gun towards himself,” the officer alleged in his affidavit.

The officer again contacted Hice “and informed him the video shows him pointing the gun at them and then turning it around and pointing it at himself,” the affidavit alleged.

“Hice stated, ‘I don’t remember doing that.’ I informed Hice he was under arrest for feloniously pointing a firearm.

“Hice began screaming and banging his head against his car. On the way to the Police Department, Hice stated multiple times, ‘I’m sorry. I know I messed up,"” the officer alleged in his affidavit.
