  (Stillwater, Okla.) — A Cushing man accused of driving a 2009 Kawasaki motorcycle while under the influence of alcohol and transporting a juvenile has been ordered to appear in court on Sept. 20 with an attorney on a two-count charge.
    If convicted of felony child endangerment, Mark Gautreau, 36, could be given a four-year prison term and a $5,000 fine. If convicted of misdemeanor driving under the influence of alcohol, Gautreau could be given a minimum of 10 days in jail and a maximum fine of $1,000.
    Gautreau was arrested at 10:27 pm on July 15 after police were sent to Greenlee and Linwood regarding “a minor vehicle accident involving a motorcycle and a dog,” Cushing Police Officer Heather Snow alleged in an affidavit.
    “Mark admitted to having at least five 12 oz. beer cans. He did state that it was possibly around an hour and half since his last drink,” the affidavit alleged.
    During a field sobriety test “he was rocking back and forth and could not stand still,” the affidavit alleged. “The rest of the standard field sobriety tests were not performed due to the pain in Mark’s knee,” the affidavit alleged.
    After three attempts of insufficient breath samples for the presence of alcohol, “Mark informed officers that he had asthma. On the fourth and successful attempt, a result came back of .128,” the affidavit alleged.
    “I informed Mark that I would follow up with the owners of the canine, which at that time officers were unable to make contact with,” Officer Snow wrote in her affidavit.
    Gautreau’s passenger, a juvenile relative, had been picked up by her mother, the affidavit said.
    Following his arrest, “Mark advised officers that he did not want to take another blow test after he had already done the portable breath test. Mark stated, ‘I’m not gonna do another breath test,’ and was requesting a lawyer,” the affidavit alleged.
