(Stillwater, Okla.) — A 21-year-old Cushing man was arraigned by video from the Payne County Jail on Tuesday on a felony charge of breaking into a truck parked at Raw Wellness dispensary at 2:54 am on Jan. 29.
At his arraignment, Hunter Charles Harkey was ordered to appear in court with an attorney on Feb. 15 on a second-degree burglary charge, which is punishable by up to five years in prison plus a $10,000 fine on conviction.
Harkey was arrested at the Cushing dispensary by Cushing Police Officer Heather Snow, her affidavit said.
“Hunter advised that he was just ‘looking for a smoke,"” the affidavit alleged.
The truck owner said, “he was in the bathroom and when he came out, he saw the lights were on in his truck outside. He went outside and discovered someone was inside,” the affidavit said.
The truck owner said he was “fearful for his life,” and “drew his firearm because he believed he was in immediate danger and thought that person could have a weapon,” the affidavit alleged.
The truck owner “escorted Hunter inside the dispensary and called 911,” then “put his weapon in the office and got a pair of scissors after Hunter claimed he did not have a weapon,” the affidavit alleged.
