(Stillwater, Okla.) — A Cushing man accused of attempting to rob a man of his cell phone by punching and throwing him on the ground in Stillwater has been ordered to appear in court on April 9 with an attorney on the felony charge punishable by 15 years to life in prison.
The defendant, Tom Elkody Boyd, 37, was released on $10,000 bail from the Payne County Jail, one day after being arrested at the intersection of 7th and Duncan Street at 3:14 pm on March 7, court records show.
A man said, “he was crossing the street while talking on his phone” when the suspect “yelled at him saying that he was talking to him,” Stillwater Police Officer Richard Alley wrote in an affidavit.
The man said, “he told Boyd that he was talking on his phone. Boyd then yelled, ‘Give me your phone now’ and punched him to the ground,” the affidavit alleged.
The man “stated Boyd jumped on top of him and was trying to beat (his) head off of the ground. Boyd was trying to get (his) cell phone, but (the man) held it in his hands,” the affidavit alleged.
The man said a juvenile male knocked Boyd off him, the affidavit alleged.
A witness said “she saw the suspect, wearing a red shirt and later identified as Tom Boyd, crossing 7th Avenue. She saw the victim crossing the street in the opposite direction,” the affidavit alleged.
She said that Boyd attacked the man “by punching him and throwing him on the ground,” before jumping on him and hitting him, the affidavit alleged.
She “then saw a juvenile run up and knock or pull Boyd,” off the man, the affidavit alleged.
“Sgt. Merrill and I took Tom Boyd into custody,” the Stillwater officer wrote in his affidavit.
