(Stillwater, Okla.) — Three brothers in Stillwater, who lived together in the 1600 block of S. Hillside Court, have been charged with possessing about one-half pound of marijuana, reportedly valued at $4,560 on the street, with the intent to distribute, as well as having drug paraphernalia.
Raul Alejandro Marin III, 28, Malachi Job Marin, 27, and Samuel Micah Marin, 22, all remain held in the Payne County Jail on $40,000 bail each pending their court appearances on June 11 when they can seek a preliminary hearing.
Approximately 228 grams of marijuana with a street value of about $4,560 was seized by Stillwater Police Officer Brett Moore, who served a search warrant at the Marins’ home on May 11, according to his affidavit.
When the Stillwater officer asked the youngest brother if he knew why he was at their home, “Samuel stated, ‘because of our drug distribution,’” the affidavit alleged.
“I advised Samuel he was correct and asked if he would be willing to show me where the drugs are typically kept. Samuel pointed out a locked safe in the middle of his bedroom floor. Samuel informed me where the key was located.
“Inside the safe, approximately six ounces of marijuana was located individually packaged in one-ounce bags. Underneath Samuel’s mattress was an envelope containing $2,050. In a drawer directly next to Samuel’s bed was an additional envelope containing $680 in different denominations.
“Additional drug paraphernalia and packaging material was located throughout Samuel’s room. Samuel continued to state the remainder of the marijuana was located in the living room,” where several mason jars containing marijuana as well as digital scales and packaging materials were found, the officer alleged in his affidavit.
“An additional $220 in different denominations was located in the kitchen cabinet within close proximity of marijuana. When asked, Samuel admitted to distributing narcotics; however, (he) stated he had not been selling for very long,” the affidavit alleged.
When the oldest brother, Raul, was asked if he knew why the Stillwater police officer was at their home, “Raul advised because he and his brothers were selling marijuana,” the affidavit alleged.
“Raul admitted the three had been selling marijuana, but only for a short time. Raul stated, ‘One of our friends who we used to buy from was getting hot and he kinda got us started.’ Raul further advised it was an easy way for them to smoke for free,” the affidavit alleged.
When the middle brother, Malachi, was interviewed, “Malachi admitted he smoked marijuana; however (he) stated he did not sell marijuana.
“I informed Malachi his brothers had already informed me the three of them had been selling marijuana. Malachi did not respond to that statement.
“A full marijuana cultivation system was located in Malachi’s room; however, it was in boxes and unused,” the Stillwater officer wrote in his affidavit.
If convicted of possessing marijuana with the intent to distribute, each of the brothers could be imprisoned for five years to life and fined as much as $100,000. If convicted of possessing drug paraphernalia described as digital scales and packaging materials, each of the brothers could be given a one-year jail term and a $1,000 fine.
