STILLWATER — A Broken Arrow man, who was freed on $250,000 bond the day of his arrest, has been ordered to appear in court on Feb. 10, 2026, on a Payne County charge accusing him of forcibly throwing his seven-month-old baby into a crib in Stillwater — resulting in bleeding around the brain of the infant.
If convicted of child abuse on Nov. 13, 2025, Dalton James Maish could be given as much as a life prison term, court records show.
The baby’s mother, who lives in Stillwater, obtained an emergency protective order on Nov. 20 on behalf of the baby and herself against Maish, 23, whom she described as an ex-boyfriend and the baby’s father. She alleged he tossed the baby in the crib and previously “put his arm around my neck trying to choke me out.”
Stillwater Police Detective Chance Whiteley wrote in an affidavit, “On 10-24-2025, I was notified of a DHS referral alleging potential abuse of an infant. During the investigation, it was discovered that the incident in question occurred in Broken Arrow.
“On 11-13-2025, I was notified that the child was once again in the hospital, and there were more allegations of abuse, but this time it occurred in the city limits of Stillwater. I interviewed the mother on 11-18-2025. (She) said that two weeks ago, she called the father of her child, Dalton Maish and asked him to come help her at her residence (in Stillwater).
“She said she and the baby were both sick with a stomach virus and she needed help. She said he arrived on Saturday (11-8-2025) heavily intoxicated and was told to leave, which he did. He came back later that evening with food and seemed sober. He wasn’t there long before he began to get upset that his son wasn’t comfortable around him, so he left once more.
“At approximately 1:30 am (Sunday 11-9-25), he came back to the house. (She) said she was lying in bed with (the baby) next to her because he had been vomiting. Dalton became angry that (the baby) was in bed with her. He picked up the child by one arm and one leg and carried him across the room before ‘chunking’ him into the crib,” the affidavit alleged.
“Dalton then returned to (her) and demanded sex from her. (She) refused and Dalton began throwing stuffed animals at (the baby’s) face. He told her that sometimes the only way she would listen to him is if he treated (the baby) in that manner.
“By the morning of 11-13-2025, (she) took the child to the doctor because he was lethargic and not himself. She began to worry that his behavior wasn’t just due to the stomach bug they had, as she was over hers. From their primary care, they were referred to OU medical.
“On the 17th, I was provided with a copy of the medical evaluation from (the baby’s) latest hospital visit stemming from the above incident. Dr. Stockett stated in that assessment ‘He has subdural fluid collection in the past but now has acute subdural blood. This is most likely due to head trauma he sustained when thrown into his crib. This indicates that (the baby) was physically abused,"” the affidavit alleged.
