(Stillwater, Okla.) — An arrest warrant has been issued for a Cushing man who failed to appear in court on a charge of concealing a stolen television — while he was on probation for threatening to kill a restaurant manager and obstructing a police officer, all in Stillwater.
Erick Dawayne Harrison Hagler, 21, was previously accused of robbing a man at knifepoint in 2011 — but that charge was dismissed when the victim could not be located to testify at a preliminary hearing.
In his latest case, Hagler could be given a five-year prison term if convicted of knowingly concealing stolen property on Jan. 18 in Stillwater, court records show.
A Stillwater woman told police on Jan. 10 that her apartment was burglarized and several items were stolen including a Phillips 42-inch LCD television for which she was able to provide detailed information, an affidavit said.
“Through the investigation, I was notified Erick Hagler pawned the above-mentioned television at EZ Pawn on Jan. 18,” at about 5:30 p.m., Stillwater Police Officer Tom Comstock alleged in an affidavit.
Hagler had been paid $150 by a clerk at the pawn shop, where video surveillance showed that Hagler was the person making the transaction, the affidavit alleged.
About a month earlier, Hagler had been placed on one year’s probation, fined $350 and ordered to take courses for anger resolution and life skills for threatening to kill a restaurant manager and obstructing an officer, court records show.
In that case, a Stillwater Pizza Hut manager reported at 12:28 a.m. on March 13, 2012, that Hagler and a 16-year-old male juvenile had just threatened to kill him, Stillwater Police Officer Charles Murphy alleged in an affidavit.
The two “had come to the store after it had closed and they were knocking on the door wanting to order a pizza,” the manager said, according to the affidavit.
After explaining that the store was closed and not taking any more orders, the store manager “asked the two to leave the property and when he did, they began cursing and yelling at him,” the affidavit said.
The store manager said “both were threatening to kill and do bodily harm to him,” the affidavit said. He also said “Erick stated he was going to shoot him and then made a move toward his pocket as if he had a gun,” the affidavit said.
The store manager said that he was scared, told them he was going to call police, retreated into the store, locked the door and called 911, the affidavit said.
The store manager said “the two then left the property and went across the street to Forty-North apartments and then were returning with two more unidentified males.
“When I pulled into the parking lot the four males ran away to the north through the apartment complex,” the officer wrote in his affidavit.
Other officers in the area were able to locate Hagler and the juvenile based on the description provided by the store manager, the affidavit said.
“Erick (Hagler) ran from Officer Manuel in the apartment complex after being told to stop when Manuel was attempting to detain Erick for investigative purposes. After a short foot pursuit, Erick was subdued with a Taser,” the affidavit said.
Hagler was positively identified by the store manager as the person who had threatened to shoot him, the affidavit said.
On Dec. 9, 2013, Hagler pleaded guilty to threatening to kill the store manager and obstructing the officer, for which he was given a one-year deferred sentence, court records show.
Two and one-half years earlier, Hagler, then 18, and Dwayne Lamar Vaughn, then 20, of Cushing, were charged together with robbing a man in Stillwater of $200 in cash at knifepoint on June 6, 2011, court records show.
The pair were jailed on $75,000 bail each for about two and one-half months, until their bail was changed to a personal recognizance bond, which they posted.
According to a motion to reduce bond filed in July of 2011 by Hagler’s lawyer, Hagler had just graduated in May 2011 from Cushing High School and received a scholarship to attend Redlands College in El Reno, for which class was scheduled to begin Aug. 22, 2011.
The felony charge of robbery by two or more persons filed against Hagler and Vaughn was dismissed on Sept. 2, 2011, on the request of the prosecutor since the state could not locate the victim for a preliminary hearing, court records show.
