Man gets 20 years in prison for Stillwater shooting

   STILLWATER — A 20-year-old man, who was 18 when he shot a customer in the parking lot of a 7-11 convenience store at 711 N. Main in Stillwater at 12:28 am on March 2 of 2025, has been sentenced to 20 years in prison followed by 15 years of probation as part of a plea agreement with the prosecution that was approved by District Judge Jason Reese in court on Aug. 14.

   At the time of the shooting, Adan Junior Pena III of Ponca City was on 20 years’ probation for kidnapping and first-degree burglary, along with two concurrent 10 years of probation for two separate convictions of possessing a firearm after adjudication as a delinquent child, all in Kay County in 2024. His probation was revoked to prison in all of those Kay County cases on April 15 of 2026, court records show.

   Pena, who has been held in the Payne County Jail on $1 million bail since his arrest the day after the Stillwater shooting, was ordered by the judge on Aug. 14, after he pleaded guilty to a three-count charge, to provide a DNA sample and comply with the violent offender registry when he completes three concurrent 20-year prison terms for assault and battery with a deadly weapon, attempted armed robbery and being a convicted felon in possession of a 9 mm handgun.

   On surveillance video from the 7-11 store in Stillwater, Pena and the victim, identified as Victor Gutierrez, are observed talking to each other, both inside and then outside the store in the parking lot before they are seen reaching towards their waistbands, Stillwater Police Detective David Adney wrote in an affidavit. The actual shooting was apparently not visible on video.

   “Victor makes it to the rear of the store before collapsing,” on the ground with a gunshot to his lower right abdomen, the affidavit said. The victim, who declined to make a statement at his assailant’s sentencing, was transported to the Stillwater Medical Center before being airlifted to OU Medical Center, a police news release said.

   “Officer R. Simpson advised me he had been conducting a traffic stop on the south side of the store when he heard a gunshot coming from the west side of the building in front of the store. Officer Simpson responded towards the gunshot and observed a dark-colored SUV with an Oklahoma personalized Thunder tag driving north away from the gas pumps.

   “Office R. Simpson returned to his patrol car and attempted to follow the SUV when he was flagged down by a bystander on the east side of the store,” where the shooting victim was found on the ground, the detective wrote in his affidavit.

   According to surveillance video, “Victor makes it to the rear of the store before collapsing. Adan jumps into the rear passenger side of the SUV, and it pulls away headed north out of the parking lot, then turns east on McElroy. In a different camera angle, you can see the SUV stop in the 100 block of E. McElroy, and see Adan run north from the SUV,” the affidavit said. Pena was arrested the next day with the assistance of the Ponca City Police Department, the news release said.

   “I interviewed all the occupants of the SUV. (One juvenile girl) stated Adan had a gun. (A juvenile male) stated he saw Adan with a gun earlier in the night, and they kicked Adan out of the SUV after the shooting because they didn’t want him in the car. (Another juvenile male) stated Adan had a gun, and he believes he was responsible for shooting the guy he was arguing with, but denied seeing the shooting,” the detective wrote in his affidavit.
