STILLWATER — A 30-year-old Yale man accused of punching three female staff members of Grand Mental Health in Stillwater in the face has been jailed on $20,000 bond pending a May 4 court appearance at which he can seek a preliminary hearing.
If convicted of three counts of assault and battery on a medical care provider, Dustin Jacob Miller could be imprisoned for 12 years to life, according to the felony charge filed last week.
Miller was arrested at Grand Mental Health at 9:01 pm on April 4, about six minutes after “someone called 911 and stated, ‘you need to get someone up here,"” before hanging up, according to an affidavit by Stillwater Police Officer Chase Mobus, who was assisted by Officer Jacob Rivera.
“Upon my arrival, I was not able to get into the building and did not detect any emergency going on in the building at that point. An employee who was coming back from her break let me in.
“As soon as we entered the main doors of the Urgent Recovery side located on the west side of the building, I observed Dustin Miller assaulting two females. It was later discovered that he assaulted three females.
“He was hitting them and pulling their hair. They appeared to be trying to subdue or calm him down. One of them was thrown to the ground as I entered the room. I yelled, ‘Hey, Stillwater police, stop! He did and I immediately placed him into handcuffs.
“He stated that that the three females would not let him leave and would not give him the correct medication. He stated that they spit on him, and he wanted to press charges. I looked Justin over and the only marks that he had were scratch marks from the victims attempting to get away. Justin insisted that they spit in his hair. There was no saliva in his hair.
“Justin has a history of public intoxication, assault, and is known to huff gasoline to get high. Over time, Justin’s condition has deteriorated and due to that fact, he is listed in our system as having mental health problems.
“Justin complained of chest pain and stated that he has anxiety and was likely having a heart attack. LifeNet arrived on scene and advised that his EKG was fine, but only a hospital could make sure that he was cleared for incarceration.
“I searched Justin and transported him to SMC. He was cleared by staff. Justin was upset that they would not give him valium. I transported him to the SPD jail where he was booked without incident,” Officer Mobus alleged in his affidavit.
The three staff members who were punched in the face all declined LifeNet services, the affidavit alleged.
