STILLWATER — A Stillwater man, who admitted damaging a bouncer’s Harley Davidson motorcycle after being kicked out of a bar south of the Oklahoma State University campus, has been given a 90-day jail term followed by two years of probation.
Larry Joe White Jr., 42, was also ordered by District Judge Jason Reese at his sentencing to pay restitution and continue his mental health treatment, as part of a plea agreement with the prosecution approved in court on July 25, court records show.
White had been arrested at 11:33 pm on May 18 by Stillwater Police Officer Matthew White, who responded to a vandalism call at a bar in the 700 block of S. Washington Street at 11:11 pm, according to an affidavit.
A bouncer “provided me with a few $1 bills, two pairs of sunglasses and an Oklahoma ID for Larry White,” who had dropped the items after being kicked out of the bar, the officer wrote in his affidavit.
The bouncer said, “he had to forcibly kick Larry out of the bar after he refused to voluntarily leave,” the affidavit said. The bouncer said, “after Larry was kicked out, he pushed over his Harley Davidson motorcycle,” the affidavit said.
“I observed significant scrapes to the right saddle bag and the right side of the fairing/cowl. I estimated the damage at approximately $2,500,” the officer wrote in his affidavit.
A witness said that he saw the defendant being kicked out of the bar and then pushing the motorcycle over, the affidavit said.
“I showed (the witness) Larry’s ID and asked if that was the male he observed push over the motorcycle, and he stated yes.
“I contacted Larry and informed him I had his property he dropped after getting kicked out of (the bar). Larry argued he shouldn’t have been kicked out and stated he had refused to leave the bar. Larry stated he was thrown out of the bar and had bounced into the motorcycle.
“Based off the location of the motorcycle from the exit of the bar, I find it unlikely Larry was pushed into the motorcycle,” the officer wrote in his affidavit.
