STILLWATER — A 67-year-old Stillwater man, who reportedly told police that “he does not use methamphetamine; however, he gives it to females in exchange for sex,” has been ordered to appear in court on Aug. 13 on a charge of possessing the drug with intent to distribute.
If convicted of the felony, Phillip Alan Warne, who was freed on $25,000 bond on June 27, could be given up to five years in prison and a $20,000 fine.
Warne was arrested at 2:03 pm on June 25 following a traffic stop in which Stillwater Police Detective Newly McSpadden’s k9 partner indicated an odor of narcotics in his car, Stillwater Police Detective Brett Moore alleged in an affidavit.
“While searching the vehicle, Detective McSpadden informed me he had located a small quantity of methamphetamine wrapped in a gum wrapper in the driver’s door. I asked Phillip if he used methamphetamine.
“He stated he never used methamphetamine. I asked him if he had never used methamphetamine, then why was there methamphetamine inside the vehicle. Phillip began sweating profusely and his breathing intensified. I asked Phillip if he was delivering methamphetamine to somebody. Again, Philip stated he was not.
“Phillip agreed to let me look at his phone at which time I observed messages between him and a female. While reviewing the messages, it was apparent that Phillip was taking methamphetamine (to her) in exchange for sexual favors. I asked Phillip if this was indeed true.
“Phillip stated it was and that he does not use methamphetamine; however, he gives it to females in exchange for sex. I informed Phillip that he was under arrest for possession of CDS with the intent to deliver,” Detective Moore alleged in his affidavit.
During a jail interview, “Phillip admitted to picking up methamphetamine about once a month. Phillip was adamant that he does not use methamphetamine; however, he does distribute it to women in exchange for sexual favors,” the affidavit alleged.
