STILLWATER — A 48-year-old Perkins man has been jailed on $10,000 bond pending a June 9 court appearance on a felony charge of drunk driving in Perkins at N. Main and Highway 33 after prior DUIs in Logan, Major and Osage counties.
Due to his criminal record, Jason Wayne Bohard could be given as much as a 20-year prison term if convicted of a fourth DUI, along with a six-month jail sentence for transporting an opened container of beer.
Bohard was arrested at 8:50 pm on April 30 in a grocery store parking lot following a traffic stop, according to an affidavit by Perkins Police Officer Chris Wooten.
“While speaking with Bohard, I could smell the odor of marijuana and the odor of an alcoholic beverage coming from inside the vehicle. I asked Bohard if there was any marijuana in the vehicle. He stated yes, it’s just a roach in the passenger seat and provided me with his medical marijuana card. Bohard stated he also had two open cans of beer in the vehicle.
“I asked Bohard when was the last time he smoked marijuana and consumed the alcohol. Bohard stated he smoked this morning around 8 am and was drinking the beer around the same time. Bohard stated he also got one of the cans of beer from Casey’s and admitted to drinking it right before I conducted the traffic stop,” the Perkins officer alleged in his affidavit.
“I could smell the odor of an alcoholic beverage emitting from his breath, his eyes to be watery, had slurred speech, had nervous like behavior, and to be unsteady on his feet. I asked Bohard if he would be willing to do the Standardized Field Sobriety tests. Bohard refused to do the test but agreed for me to check his eyes.
“Bohard continued to complain of his hip and still refused to do any further tests. Bohard continued to have a nervous behavior and stated, ‘just take me to jail,"” the officer alleged in his affidavit.
After arresting Bohard, during an inventory of his vehicle, the officer saw two open 25 oz Busch cans of beer half full in the center console area under a hat, as well as a black and yellow Scotty 2 Hotty cannabis THC tube containing a burnt marijuana roach, his affidavit alleged.
According to court records and the state Department of Corrections, Bohard had previously received probation for DUI in Logan County in 2023, DUI in Major County in 2013, and DUI in Osage County in 2011. Bohard had also been convicted in 2019 of second-degree burglary and grand larceny in 2018 in Osage County for which he was incarcerated for 10 months in 2019, when he began serving three years of probation, DOC records show.
