(Stillwater, Okla.) — A bench warrant was issued Tuesday for the arrest of a 34-year-old man, who failed to appear in court on a 2023 charge accusing him of sexually battering a woman at his Stillwater residence on N. Dryden Circle in 2021.
Due to his criminal record in Arkansas, Joey Wayne Le, who had been released from the Payne County Jail on $10,000 bond, could be imprisoned for two years to life if convicted of approaching a woman while she was sleeping and then sexually touching her, court records show.
A woman contacted Stillwater police at 7:20 pm on Oct. 17, 2021, regarding a sexual assault that occurred at Le’s residence during the early morning hours that day, an affidavit alleged.
She “disclosed going with a group of friends to Joey Le’s house after being at the bars on S. Washington St.
“Prior to leaving the bar, several in the group told Joey they were going to give one of the girls a ride home due to her level of intoxication, and they did not want her driving.
“(She) said Joey got upset and told them he was going to take her home. An argument ensued after this, and everybody went to Joey’s house.
“While at Joey’s house, (she) fell asleep on the couch, which is in the living room,” and woke up to finding him sexually touching her, the affidavit alleged.
“(She) said someone came into the room, and Joey stopped. When Joey stopped, she began to cry and Joey left the room,” the affidavit alleged.
According to Payne County court records, on March 10, 2010, in Crawford County, Arkansas, Le had been convicted of sexual indecency with a child and sentenced to five years suspended except two years in prison.
