    (Stillwater, Okla.) — A 59-year-old Stillwater man, who remains free on $7,500 bond, has been ordered to appear in court on Feb. 3 on his fourth drunk driving charge, which carries a prison term of up to 20 years on conviction.
    Brian Dion Klein had been arrested by Oklahoma Highway Patrol Trooper Ryan Long at 12:55 pm on Jan. 11 for allegedly driving under the influence of alcohol at Perkins Road and 8th Street in Stillwater, court records show.
    “When asked to provide a driver’s license, Klein presented only his Oklahoma Identification card,” the trooper alleged in his affidavit. A records check confirmed that Klein’s driver’s license was suspended,” the affidavit alleged.
    The trooper, a nationally certified Drug Recognition Expert, “detected the odor of an alcoholic beverage emitting from Klein’s breath,” the affidavit alleged.
    “When questioned, Klein admitted to consuming alcoholic beverages the previous evening and stated he had stopped drinking at approximately 1 am,” the affidavit alleged.
    After administering Klein field sobriety tests, “Trooper Long then retrieved a portable breath test device issued by the Oklahoma Highway Patrol. Klein provided a breath sample, and the device displayed a result that was consistent with Trooper Long’s observations of impairment,” the affidavit alleged.
    According to court records and the Oklahoma Department of Corrections, Klein had been released from prison in August of 2013 after serving a year and a half of four concurrent five-year prison terms from Payne County in 2011 for preventing a witness from attending court in 2011, actual physical control of a vehicle under the influence in 2010, drunk driving in 2009 and drunk driving in 2008; he also concurrently served 15 months of four-year prison term he was given from Payne County in 2011 for child endangerment in 2010.
    Klein had also been given a five-year suspended sentence in 2008 for drug possession in Payne County and two concurrent five-year suspended sentences in 2015 for drunk driving in 2014 in Noble County and actual physical control as a third offense in 2013 in Noble County, court records show.
