(Stillwater, Okla.) — A 39-year-old Perkins man has been jailed on $150,000 bail pending a Dec. 2 court appearance on charges of trafficking fentanyl along with possessing methamphetamine, marijuana and drug paraphernalia in Ripley.
Brandon Keith McCutchen, who had been released from prison earlier this year, was arrested at 3:07 pm on Oct. 14 in the 100 block of N. Biddle in Ripley by Payne County Sheriff’s Deputy Spencer Gedon, court records show.
The deputy was patrolling the Ripley shopping district when he saw a man who “appeared to be agitated and threw a dark-colored hoodie and a small red container onto the ground, picked up the items and walked south,” according to his affidavit.
Deputy William Bowen “asked the male if he was all right based on his agitated behavior,” Deputy Gedon alleged in his affidavit.
A bystander “told me to look under the shed just west of our location; the bystander “told me the man had thrown something under the shed right before I contacted him,” Deputy Gedon alleged in his affidavit.
“I walked over to the shed, looked underneath it and saw a small red container,” that had a small digital scale with white residue and several small baggies,” Deputy Gedon alleged in his affidavit.
The container with the small scale had two small baggies with a white crystal substance, two baggies of a green leafy substance, three syringes and multiple small baggies, the affidavit alleged. A field test of the crystal substance showed it was positive for methamphetamine, the affidavit alleged.
At the Sheriff’s Office, a crystalized substance in four baggies tested positive for methamphetamine and fentanyl, the affidavit alleged. A large baggy tested positive for marijuana, while a small baggy did not test positive, the affidavit alleged.
A syringe loaded with a crystal substance tested positive for methamphetamine and fentanyl, while two other syringes appeared unused, the affidavit alleged.
A large baggy contained 11 unused baggies with blue dolphins imprinted on them; another large baggy contained 30 unused baggies with 8 balls imprinted on them, the affidavit alleged.
The digital scale and the red container both had residue that tested positive for methamphetamine and fentanyl, the affidavit alleged.
“I returned to the Payne County Jail and seized Brandon’s cell phone to request a search warrant for it as he was being charged with possession with intent to distribute narcotics, and he was headed to a residence known for drug use and distribution. Brandon declined to provide me with his passcode,” Deputy Gedon alleged in his affidavit.
Court records show that McCutchen had been convicted of drug trafficking in 2021 in Payne County and was given a five-year prison term in April of 2023, but apparently only served about a year before being released this year.
McCutchen had been convicted in October of 2018 of being a felon with a firearm and possessing stolen property in Lincoln County; he was given a 10-year prison sentence with the balance suspended on completion of the Bill Johnson Drug Offender Work Camp, which he apparently did in September of 2019, state Department of Corrections records show.
