(Stillwater, Okla.) — A 67-year-old Stillwater man, who was allegedly receiving messages on his cell phone from individuals asking for drugs while police were in his apartment, was arraigned Tuesday from the Payne County Jail on a charge of possessing methamphetamine with intent to distribute.
If convicted of the felony, Michael James Lex could be given as much as a seven-year prison term and a $100,000 fine, according to the charge.
Lex was arrested at his apartment in the 800 block of S. Lowry Street at 1 pm on June 18 during the service of a search warrant obtained by Stillwater Police Officer Josh Carson, according to an affidavit.
“I noticed the door to the apartment was standing open. A male, whom I know as Michael Lex, was standing just inside the doorway. Lex immediately told me he wanted a lawyer present and stated he did not wish to talk to me,” the officer alleged in his affidavit.
“I found methamphetamine, packaging material and working digital scales in the apartment. A ledger was found with familiar names, drug amounts, and the amount of money owed or spent with Lex written on it. From my training and experience, drug dealers often use ledgers to track the money they are making on the drugs they are selling,” the officer alleged in his affidavit.
After the arrest, “$196 was removed from Lex’s person as well as a cell phone…I did not manipulate the phone in any way, but in the course of my investigation Lex was receiving messages from individuals asking for drugs and the messages were coming up on the screen as we processed the apartment,” the officer alleged in his affidavit.
“In total, approximately three grams of methamphetamine was seized,” the affidavit alleged.
