(Stillwater, Okla.) — A Cushing woman, who was reported by the Iowa Tribe Police Department as being intoxicated when she left the Cimarron Casino, has been charged with assaulting and spitting on Perkins Police Detective Billy Laster after he arrested her for drunk driving on Feb. 18.
Lisa Marie Martinez, 50, was released from the Payne County Jail on $7,500 bond on Feb. 19, arraigned on Feb. 23, and ordered to return to court on March 23 with an attorney on a three-count charge.
After field sobriety tests on the dry concrete covered patio at the Cedar Wood Market, Martinez was arrested for drunk driving at 8:40 pm and became uncooperative after the detective attempted to handcuff her behind her back, the Perkins detective alleged in an affidavit.
“I did not want to injure Martinez, so I handcuffed her wrists on the front side of her body. At one point she took her right elbow and turned into (Iowa Tribe Police Officer Colt) Savage. I did not know if she did this on purpose and warned her about assaulting a police officer,” the Perkins detective alleged in his affidavit.
“Once she was in my vehicle, she continued to be uncooperative and she spat in my face. I felt her saliva hit my forehead and nose. At that point I told her she would be charged with placing bodily fluids on a police officer.
“She continued to be uncooperative and she hit me in my mouth causing pain to my upper lip. I informed her she would be charged with assault and battery on a police officer,” the Perkins detective alleged in his affidavit.
“At the jail, Martinez had a bottle of vodka concealed in her clothing. I seized the bottle of vodka, which had some liquid left in it,” the Perkins detective alleged in his affidavit.
Martinez had told the detective “she drank vodka approximately one hour before the traffic stop and said she had two shots,” the affidavit alleged.
Payne County Sheriff’s Deputy David Sloan administered a breath test, which showed that Martinez had .19 of alcohol in her system, the affidavit alleged.
