(Stillwater, Okla.) — A former Cushing man with a history of drug convictions has been ordered to appear in court on March 18 for arraignment on a charge of possessing methamphetamine with intent to distribute, in a case investigated by Stillwater police.

Kelly Ray Davis, 44, of Stillwater, said “he was selling methamphetamine in an attempt to make money due to not having a job,” Stillwater Police Officer Brett Moore alleged in an affidavit filed earlier this month.

During a traffic stop at 4:18 pm on Jan. 29 in Stillwater, “Kelly Davis jumped out of the passenger side while the vehicle continued rolling through the parking lot,” the affidavit alleged.

“Detective Carson and Detective McSpadden exited my vehicle and detained Kelly while I stopped the vehicle,” and contacted the driver, the officer alleged in his affidavit.

“Detective McSpadden informed me he and Detective Carson had located a black leather tubular case on the ground next to Kelly,” the officer alleged in his affidavit.

“At the police department I discovered the case contained 25 prepackaged zip top baggies of methamphetamine,” which were broken into .3 and .4 gram bags, the officer alleged in his affidavit.

“The container also contained one zip top plastic baggy of heroin. Kelly also had $245 in US currency, which was seized at the time of his arrest,” the affidavit alleged.

According to Payne County court records and the Oklahoma Department of Corrections, Davis had previously been given concurrent prison terms for:

* possession of methamphetamine and marijuana in 2003 for which he was given probation that was revoked in 2013 to a seven-year prison term of which he served about one year and eight months;

* possession of methamphetamine and marijuana in 2009 for which he was given probation that was revoked in 2013 to nine and one-half years of prison of which he served about two years and two months;

* possession of marijuana in 2012 for which he was given in 2013 a 10-year prison term of which he served about two years and three months;

* endeavoring to manufacture methamphetamine in 2012 for which he was given in 2013 a 10-year prison term of which he served about two years and three months.
