(Stillwater, Okla.) — A truck driver accused of drunk driving while his license was suspended and hitting three vehicles at 6th and Western in Stillwater as well as resisting arrest has been jailed on $25,000 bail pending a court appearance today.

If convicted of his four-count charge, Daniel Eric Johnson, 49, of Stillwater, could be incarcerated for as long as seven years and fined $6,500, court records show.

Stillwater Police Officer Miguel R. Najera was sent at 6:47 pm on Dec. 17 to a hit and run accident at 6th and Western that involved three vehicles along with damage to a building, according to his affidavit.

“The vehicle left the scene going south on Western and then west on 19th towards Sangre. The vehicle had extensive body damage missing the front driver’s tire and the back driver’s tire was shredded with sparks and smoke coming from both rims.

“There was also extensive damage to the driver’s rear side. There was no way a driver would not be aware of the damage or accident,” the affidavit alleged.

The vehicle driven by Johnson came to a stop in a convenience store parking lot at 19th and Sangre, the affidavit alleged.

“Daniel yelled, cursed, flipped me off and disobeyed commands to keep his hands in the air. Daniel refused to obey commands to walk backwards towards me.

“Daniel did go to his knees at one point as instructed, but then refused follow-up commands and stood up and challenged me. Additional officers arrived on scene and Daniel was tased by a Payne County deputy after refusing multiple commands to get on the ground,” the Stillwater officer alleged in his affidavit.

“While attempting to handcuff Daniel, he refused to give me his left hand and it had to be pulled from under his stomach,” the Stillwater officer alleged in his affidavit.

“Daniel refused to perform any field sobriety tests or take the state’s breath test,” although he smelled of alcohol, had slurred thick speech, was unsteady on his feet and had glassy eyes, the affidavit alleged.
