(Stillwater, Okla.) — A Cushing man accused of drunk driving as a third offense has been ordered to appear in Payne County District Court on July 21 on a felony charge that carries a maximum penalty of 10 years in prison on conviction.
Richard Concoles Govea, 24, was previously convicted of drunk driving as a misdemeanor in Montgomery County, Texas, in 2017, and given a 20-day sentence, court records show. Govea was convicted of drunk driving as a second offense in Erath County, Texas, in 2019, and sentenced to one year and five days of confinement, court records show.
In his latest case, Govea was arrested at 3:02 a.m. on June 7 at 32nd and Perkins Road in Stillwater by Payne County Sheriff’s Deputy Dalton Ross after a traffic stop at about 2 a.m., according to his affidavit.
“As I got behind the vehicle, I observed the vehicle only had one tag light that did not illuminate the tag to make it readable,” the deputy alleged in his affidavit.
“Govea handed me a Texas identification card and informed me that he did not have a driver’s license,” the deputy wrote in his affidavit.
“I could detect an odor commonly associated with an alcoholic beverage emitting from the car.
“Govea informed me that he had consumed a mixed drink approximately an hour ago and then three or four beers approximately 30 to 35 minutes ago,” the deputy alleged in his affidavit.
“I spoke with Govea and asked him if he would be willing to have a portable breath test administered…Deputy Carruba arrived on scene and administered the test.
“As Govea was speaking to Deputy Carruba, I heard him say he had a couple of mixed drinks and three or four beers. This was inconsistent with what he told me,” the deputy alleged in his affidavit.
After Govea’s arrest on suspicion of drunk driving, “While on the way to the jail, Govea informed me that he did not wish to take the state’s test informing me it was just more evidence against him,” the deputy alleged in his affidavit.
Govea was released from the Payne County Jail later that day when he posted $1,000 bond, court records show.
