(Stillwater, Okla.)  A convicted murderer was charged Monday with possessing a cell phone, which is considered contraband in prison, at the Cimarron Correctional Facility in Cushing on Oct. 1, in a case investigated by the Oklahoma Department of Corrections.

 

If convicted of his latest charge, Vincent Delmarco Berry, 26, faces a minimum 20-year prison sentence due to his criminal record.

 

According to DOC records, Berry has been in the Cushing private prison since February 2010 — serving three consecutive life prison terms plus 60 years for first-degree murder and four counts of assault and battery with a deadly weapon, all in 2008 in Tulsa County.

 

A Tulsa County jury, which convicted Berry of all five counts in January 2010, had recommended three life prison terms and two 30-year prison terms at his trial, court records show. A Tulsa County judge ordered that all five prison terms run consecutively, court records show.

 

In February 2010, Berry was given concurrent five-year prison terms for possession of a drug with intent to distribute and knowing concealing stolen property, both in 2008 in Tulsa County, DOC records show.

 

Berry was also given in February 2010 a concurrent seven-year prison term for intimidation of a witness in 2009 in Tulsa County, DOC records show.
