(Stillwater, Ok.) — A 30-year-old Guthrie man on probation for burglary in Logan County has been charged in Payne County with breaking into his father’s employee’s car in a parking lot at the Cimarron Casino in Perkins.
If convicted of second-degree burglary, Chad Derrick Kyle could be incarcerated for two to seven years, according to the felony charge filed last week.
“Chad comes to the casino frequently and plays in the high stakes room,” according to the casino manager, Perkins Police Officer George Hannon wrote in an arrest warrant affidavit filed in court records last week.
“Chad hits the jackpot frequently and so she has had contact with him during payouts,” the officer was told by the casino manager, the affidavit said.
The Perkins officer had been sent to the casino at 7:44 a.m. on July 31 on a report that a vehicle had been broken into in the west parking lot, the affidavit said.
A 56-year-old woman said that she thought “my boss’s son, Chad Kyle,” had broken into her car, but she was unsure if she had locked her doors, the affidavit alleged.
She said that her cell phone, a checkbook from her husband’s business and a full prescription of Phentermine were missing from her car, the affidavit said.
She said “there were possibly expired credit cards in the glove box that she hadn’t cut up yet,” and that her personal checkbook might have been taken as well, the affidavit alleged.
She said “Chad was at the casino and spoke to her earlier,” the affidavit alleged.
The casino manager “identified Chad Kyle as the person in the surveillance video,” the officer was told by security personnel, the affidavit alleged.
“I reviewed the surveillance video and compared the video to the photo I received of Chad,” from the sheriff’s office in Pottawatomie County where he had been charged with grand larceny on July 9, the officer alleged in his affidavit.
“Due to the subject in the video keeping his head down and covered with a baseball hat, I was unable to identify the person in the video,” the officer wrote in his affidavit.
When the officer talked to Kyle’s mother, she said “Chad stole a checkbook belonging to her and her husband,” and “Chad wrote several checks to himself cleaning out their account,” the officer alleged in his affidavit
The Perkins officer was unable to reach Kyle on his cell phone, the affidavit said.
On Aug. 1, the Perkins officer returned to the casino to have surveillance staff check the time to see if Kyle was seen on camera speaking to the victim, as she had indicated, the affidavit said
On the video, “At 2:27 a.m. you can see Chad approach (the victim) and speak to her. Chad pats (her) on the back. Chad stays with (her) until 2:56 a.m. when he walks away,” the affidavit alleged.
Based on the identification made by the victim and the casino manager, along with video allegedly showing Kyle removing items from the vehicle, the Perkins officer requested an arrest warrant for him, according to the affidavit.
Three years ago in Logan County, Kyle was placed on five years’ probation with an order to enroll in and successfully complete the Drug Court program for second-degree burglary and conspiracy to commit second-degree burglary in 2010, court records show.
