(Stillwater, Okla.) — A Stillwater man convicted of molesting a young female relative more than 20 years ago avoided a jury trial this week on a charge of sexually abusing another young female relative in 2014 by pleading guilty on Sept. 4 to a felony charge that was reduced by the prosecution to assault with intent to commit lewd molestation, court records show.
Mack Harold Posey Sr., 57, must register as a sex offender for the rest of his life under District Judge Phillip Corley’s order on Sept. 4.
Posey was given a six-month jail term, which he has already completed with credit for the time he served awaiting trial, followed by probation for four and one-half years, court records show. Posey must also pay for the cost of his incarceration.
Due to his criminal record, Posey could have been given a life prison term without the possibility of parole if a jury had convicted him of his original charge of lewd or indecent acts to a child in 2014 after a former felony conviction, court records show.
The child’s parents were charged with failure to protect their 5-year-old daughter from the threat of harm in 2014 by allowing her to live in the same home with Posey, who they knew had previously admitted molesting another child, court records show.
That charge was dropped against the child’s mother last week, a month after she obtained a divorce from the child’s father, who has been scheduled to appear in court on Nov. 6.
According to state Department of Corrections records, Posey was convicted in 1994 of child molestation in Payne County for which he was given a five-year prison term and released in 1999.
Four years later, Posey was convicted of possessing marijuana in Payne County in 2001 and placed on probation for three years, court records show.
In 2009, Posey was convicted of aggravated drunk driving in Payne County and placed on probation for four years, with a 75-day jail term.
Less than three years later, his probation was revoked and he was sent to prison from which he was released in 2013, DOC records show.
