(Stillwater, Okla.) — A Garfield County teenager accused of having sex with a 15-year-old girl and asking her to send him nude photographs of herself through Facebook or by text message was released from the Payne County Jail Wednesday after posting $15,000 bail.
Tyler Martin, 19, of Lahoma, had been advised by Payne County Special District Judge Robert Hert that a condition of his bond was that he have no contact with the girl. He was ordered to appear in court on April 1 with an attorney.
Stillwater Police Detective Sgt. Jeff Watts wrote in an affidavit that on the day after Christmas he observed a forensic interview at the Saville Center in Stillwater with a 15-year-old girl whose parents had learned she allegedly had sex with Martin.
While the detective sergeant was watching the interview from an adjoining room through a one-way mirror, the girl said “she was introduced to Tyler Martin through a mutual friend on Facebook,” the affidavit alleged.
She said that she conversed through messages on Facebook with Martin, who asked that she send him nude photos of herself, the affidavit alleged.
She said that she initialy declined to send him any photos, but ended up sending him pictures of herself in her underwear that she had taken at her residence in Payne County, the affidavit alleged.
She said that Martin asked her to have sex with him, which she said she initially delined to do, “but after thinking about it, she agreed to have sex with him,” the affidavit alleged.
She said “on Dec. 10, 2013, her parents were away from her home working and she and Tyler (Martin) were communicating through Facebook,” the affidavit alleged.
She said Martin drove to the area of her house and parked nearby, the affidavit alleged. She said “she left her home, got into Tyler’s vehicle, and they drove to a trailer house in Stillwater,” where they had sex on his bed, the affidavit alleged.
She said “while she was at the residence, employees from Rent-A-Center arrived to pick up Tyler’s bed,” so she hid in the bathroom since she was underage and didn’t want to be discovered, the affidavit alleged.
She said that after they had sex, Martin took her back home and they continued to communicate through Facebook, the affidavit alleged.
“She said Tyler (Martin) requested she send nude photos to him through Facebook,” so she took a picture of her genital area while she was in a small community and sent it to him through Facebook, the affidavit alleged.
She said that Martin sent her a picture of his genital area through Facebook, the affidavit alleged.
She said “she believed Tyler (Martin) knew she was 15-years-old because her age is listed on her Facebook account and Tyler had made comments about her parents not approving of them being together,” the affidavit alleged.
When the detective sergeant spoke to the girl’s mother, she said “she learned that her daughter had been messaging Tyler (Martin) through Facebook through a mutual friend,” the affidavit alleged.
The girl’s mother said “she read some of the messages which were sexual in nature,” but said that she did not know initially know they had engaged in sexual activity, the affidavit alleged.
The girl’s mother said that she contacted Martin on the phone number listed on his Facebook account, the affidavit alleged. She said when Martin answered, she told him that she was the girl’s mother and he hung up on her, the affidavit alleged.
The girl’s mother said that she and Martin communicated by text message in which she told him she was going to go to the police, the affidavit alleged.
She said that Martin told her “it was consensual and they would just send her daughter away,” the affidavit alleged. She said she conversed with Martin several more times and told him that her daughter was only 15, the affidavit alleged.
“Tyler (Martin) responded stating her daughter was the one who asked him and they couldn’t change the fact that it happened,” and she should drop it, the affidavit alleged.
When the detective sergeant talked to Martin at his residence in Lahoma, he said he met the girl through Facebook, the affidavit alleged.
Martin said that they talked and she sent him a picture of herself in her underwear, the affidavit alleged. He said they talked “about hanging out, but he was worried about what her parents would think because of their age difference,” the affidavit alleged.
Martin said he knew she was 15 and he was 19 at the time, the affidavit alleged.
Martin said that she asked him to come to her house and pick her up so he did, the affidavit alleged.
Martin said that they went back to his residence in the 2900 block of E. 6th Street in Stillwater and had sex before he took her home, the affidavit alleged.
Martin said that he later requested a nude photo of the girl and “she sent him a photo but he was not able to open it,” the affidavit alleged.
If convicted of having sex with the underage girl, Martin could be sentenced to one year to 15 years in prison for second-degree rape, court records show.
If convicted of making indecent proposals to the girl, Martin could be sentenced to three years to 20 years in prison, court records show.
